RESOLUTION VACATING STREET
Pursuant to petition of a majority of the property awners abutting
on that part of Windsor Avenue hereinafter described and it appearing that
hearing was held on this date pursuant to two weekst published and posted
notice thereof.,
NOWs THEREFORE., BE IT RESOLVED., By the Village Council of the
Village of Edinat that that portion of Windsor Avenue described as follows:
Beginning at the Southeast comer of Lot-Four (4). Block

COUNCIL
presented to the Council the request of an a ern urg and Moss, Attorneys, on behalf
of Mr. Alden L. Allen, 5300 Windsor Avenue, for permission to convey certain portions
of "Vacated Windsor Avenue" to two of his neighbors. At the time of the Vacation
Proceedings, title to all of the vacated street transferred to Lot 19 Block 66
Westchester Knolls,.owned by Mr. Allen, Mr. Allen's difficulty in making transfers
results from the Village Council's action some years ago, prohibiting the division
of an unplatted tract of less than 2 -1/2 acres without filing a plat therefor. In
addition to selling part of Lot 19 Block 6, Westchester Knolls, together with part
of the vacated street, Mr. Allen wish**, now, to transfer a portion of original
Lot 19 Block 6, Westchester Knolls, together with a portion of Vacated Windsor Avenue
to the owner of Lost 5, Block 20 Richmond Hills 2nd Addition (this property being
contiguous to said Lot 59 Block 2), and to convey to the owner of Lot 46 Block 2,
Richmond Hills 2nd Addition that portion of the vacated street which is contiguous
to his lot. Mr. Hite reported that neither of these proposed eonveyanass will result
in a building lot because neither tract proposed to be conveyed has street fronts& *.
Stating that there is no objection to the conveyances as proposed, Mr. Hite added
that said conveyances should contain the restrictions an the land imposed by the
Village at the time the street was vacated; i. *., 1. Perpetual easement toVillage for
care and maintenance of all utilities located in said street, and 2. Village right of
direct supervision and control over placing of any fill or grading of this property by
owners. He stat *d, further, that should Council permit conveyances as request *d, newly
conveyed properties should be combined with their respective platted lots; to form
three "legally described" parcels. Tupa's motion for approval in principle of
conveyance as requested, with the understanding that conveyances will contain land
restrictions imposed by Village at time of street vacation, was seconded by Rix* and
carried, with Trustee VanValk•nburg not voting.

As a supplement to action taken by Council an January 14, 1963, (Page S. Minute Book 26)
Tupa offered the following Resolution and moved its adoptions
RESOLUTION PERMITTING CONVEYANCE OF "VACATED
WINDSOR AVENUE, "SUBJECT TO CERTAIN RESTRICTIONS
THEREON
BE IT RESOLVED by the Village Council of the Village of Edina, as follMoss
1. That the following described property which includes a present building lot
and a part of said vacated Windsor Avenue shall be considered a proper building
lots
"All that part of Lot 1, Block 6, Westchester Knolls Addition, and that
portion of Windsor Avenue formerly.knowsi as Westchester Avenue described
as follows# ' Commencing at the Northwest corner of said lot, thence South
to the Southwest corner, thence East 128.81 feet to a point on the
Northerly line of the Minneapolis, St. Paul, Rochester and Dubuque
Electric Traction Company right -of -way (now known as Minneapolis Northfield
and Southern Railroad), thence Northeasterly along the Northerly line of
said Railroad right -of -way 12.8 feet, thence Northwesterly 146.38 feet to
.a point on the Northerly line of said lot distant 77 feet East from the

RESOLUTION
January 14, 1963
The request of Alden L. Allen, 5300 Windsor Avenue for
permission to convey certain portions of "vacated Windsor Avenue"
was presented. Mr. Hite indicated that conveyances as proposed
did not constitute building lots. This request for approval by
the Council was necessitated by virtue of the "certified copy of
the ordinance of the Village of Edina, Hennepin County, Minnesota
dated April 8, 1952 and filed April 8, 1952 in book 641 of
Miscellaneous at page 45 and pursuant to Minnesota Statutes MSA
471.26 et seq. ".
After discussion, as indicated in the offical minutes of
January 14, 1963 Tupra offered the following resolution and moved
its adoption:
1. That the following described property which
includes a present building lot and a part of said vacated
street shall be considered a proper building lot:
All that part of Lot 1, Block 6,
Westchester Knolls Addition, and that portion of
Windsor Avenue formerly known as Westchester Avenue,
described as follows: Commencing at the Northwest

corner, thence East 128.81 feet to a point on the

in connection with the above property for your approval
and Maynard's as well. I would suggest something along
the following lines:

of -way (now known as Minneapolis, Northfield
and Southern Railroad).
4. That such approval as is herein
given shall be subject to the limitations of
that certain prior resolution of the Village
Council vacating a certain portion of Windsor
Avenue, said resolutionbeing dated
and filed as Document No. in e
Office of the Register of Deeds in and for
Hennepin County, said resolution reserving to
the Village of Edina the right to install sanitary
sewer on said vacated premises and reserving to
the Village of Edina the right to control excava-
tion of dirt on said premises.
Next I am enclosing a photocopy of a survey made showing
Mr. Allen's lot and the part of the street that goes with it.
The survey was made for Mr. Dobbelman but actually covers
Mr. Allen's lot.
I realize that there may be one or two minor changes
that you would like to make in this and that really all you
wanted from me was the legal descriptions of the parcels involved.
