Village of Edina and unto its successors and assigns until January 19 1956,
The parties of the first part do hereby covenant with the Village
of Edina that they are lawfully seized and possessed of the real estate
above described; that they have a good and lawful right to convey it, or
any part thereof; that it is free from all encumbrances; and that they
will forever warrant and defend the title thereto against the lawful

husband and wife, of the County of Hennepin, State of Minnesota, parties
of the first part, and the Village of Edina, a munieipal corporation, of
the County of Hennepin, State of Minnesota, party of the second part,
WITNESSETI, That for and in consideration of the sum of One
Dollar (51600) and other good and valuable consideration, cash in hand
paid, the receipt of which is hereby acknowledged, the parties of the
first part have this day bargained and sold, and by these presents do
bargain, sell, convey, transfer, and deliver unto the Village of Edina,
an easement and right -of -way, including the right-to enter upon the real
estate hereinafter described, at any time that trunk sewer ®� 69 is
in process of construction but not later than January 1, 1956, for the
purpose of facilitating the construction of sanitary trunk sewer No. 69
at and near the hereinafter described lands, and the further right to
deposit upon said lands all dirt, stones, boulders, sand and gravel
which shall be necessary or incidental to the construction of said
trunk sewer _ Te_ (g with the right to allow said dirt, stones, boulders,
sand and gravel to remain for a reasonable length of time during construc-
tion of said sanitary trunk sewer but not to remain later than
January 1, 1956,
The land affected by the grant of this easement and right,.of -Way
is located in the County of Hennepin and State of Minnesota, and is more
particularly described as follows:
Let 20 and gmth 23 feet, of lot 9s Bleck 16: West Nimeapo2ls Heights.
The constr stLen - eaaeEent is the vest 30 feet of the above described property.
