TRANSCRIPT FROM MINUTES OF THE REGULAR COUNCIL MEETING
OF THE EDINA VILLAGE COUNCIL, HELD MONDAY, OCTOBER 28,
19679 AT 700 P.M., AT THE EDINA VILLAGE HALL.
Members answering Rollcall were Bank, Dickson, Fronk and Tupa. Mayor Pro
Tem Fronk presided.
STORM SEWER EASEMENT RETURNED. Engineer Zikan reported that Mr. Nat Johnson,
9412 Halifax Lane, has requested vacation by the Village of the Storm Sewer
Easement granted to it by Douglas Rees and Maxine V. Rees in 1941, in "the
Southerly Five Feet of Lot Five, Southridge Addition ", which Lot 5 is now
owned by Mr. Johnson. Mr. Zikan told the Council that this easement is not
needed because of the storm sewer improvement now in Elmwood Terrace, and
recommended that it be returned to Mr. Johnson. Bank's motion, that easement
be vacated by the Village, was seconded by Dickson and carried.

I, the undersigned, being the duly qualified and acting Village Clerk of the
Village of Edina, Minnesota, do hereby certify that I have compared the
attached and foregoing extract of minutes with the original minutes on file

transcript of the minutes of a meeting of the Village Council of said Village
duly called and held on the date therein indicated as far as such minutes
relate to Vacation of Easement.

quit claim deed from the Village of Edina to lilt W. and Eloise
D. Johnson, which deed releases the Village's interest in the four
quit claim deeds referred to therein. We have revised the legal
description of the two quit claim deeds conveyed for streetpurposes
to conform to the vacation proceeding. Mr. 7kan has advised us
that the two drainage easements are of no further benefit to the
Village.

I an doing some work relative to the title to property sold by Nat W
Johnson to P & S Construction Co. Donald Unwr *zami.ned the title for
the party that P & S Construction Co. sold to, and Don has raised some
questions relative to certain easements granted to the Village of .hsdina
by tormer owners of this property.
There are one or two of these quit claim deeds that grant the Village of
Edina an easement for street purposes over certain small tracts of land.
The statute provides that the village may vacate streets+ but it is doubt-
ful in Mr mind if the village council has the power by resolution to vatate
a street were it has been given the street, not by dedication of a plat or
by user over a sufficient length of time but by a quit claim deed granting
an easement to the village.
Accordingly I believe it to be the better practice to request the village
council to execute a quit claim deeds releasing the said street easements
and at the sar time the deed in question would release certain drainage
easements that were heretefor granted to the village.
Jerry Streator oZ P & S Construction Company will appear at the meeting of
the }Edina Village Council next Monday, December 15th, and I will do my
best to have Bat Johnson also appear at the said meeting.
I an sending a copy of this letter to fiat Johnson and a copy to Don Brow,
and I would greatly appreciate hearing from anyone involved in this matter
before the neeting Monday evening, which inci.dently I cannot attend because
of previous commitments*
I am enclosing a copy of the quit claim deed that we are requesting the
Village of Ednia to sign, and I trust that you will have an opportunity to
review it so that this natter may be cleared up at an early date.
