HomeMy WebLinkAbout364Tom M37 PAGE 98 2932149 EASEMENT FOR UTILITIES THIS INSTRUMENT, Made this 7 day of �[8reh �,�5, by and Fred McDowell between and Hazel Ye mswelh (Husband and wife) and � , of the County of Hennepin and State of Ninnesota, parties of the first part, >and the Village of Edina, a municipal corporation of the County of Hennepin and State of Minnesota, party of the second part; 4,IITNESSETH, That the said parties of the first part, in consideration of One and no /100 (1o00) Dollars, to them in hand paid by the said party of the second part, bye receipt whereof 3.8 hereby acknowledged, do Grant, Bargain, Sell and Convey to said party of the second part an �;as6ment for the purposes hereinafter set forth, in and over the following described property situated in the Village of Edina, County of Hennepin and State of !Minnesota, to wit: Parcel 0800, Sec. 30, T. 117, R. 21 Commencing at the N.W. corner of Be 1/2 of N.E.1 /4 of S.E. 1A of N. W. 1/4; thence S. 180 ft.; thence S. 450 E. 127.28 ft.; thence S. parallel with the W. line of E. 1/2 of NE1/4 of Nwi /4 to the South line thereof; thence E. to the S* E. corner thereof; thence N. to the N.E. corner thereof; thence W. to the point of beginning. The 10 foot wide utility easement begins at a point 80 feet south of the N.E. corner and adjacent to the east line of the above described property and extends to the N.E. corner thereof. The party of the second part also hereby agrees that as part of 'the consideration for the parties of the first part in the signing of this agreement, that the party of the second part shall in no way damage or cause damage to be done to the line of blue spruce trees facing Maloney Avenue on the above mentioned property, of which one at least will be in very close proxcimity to the required easement. It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said utilities., replace -the surface after any excavation in connection with such construction or maintenance work, in a� nearly as possible the same condition as before such excavation. The duration of this easement shall be perpetual. The parties of the first part hereby covenant and warrant that they have good title to said real estate and that they will warrant and defend the said easement and the enjoyment in use thereof to the party of the second part; and the parties of the first part make that warranty for themselves, their heirs and assigns forever, i i 7PAGE IN WITNESS .'HEREOF, The said parties of the first part have hereunto set their heads and seals the day and year first above written.
