Bogen to register title to the property platted as Fjeldheim Addition and land to the North thereof lying within Section 8, Township 116, Range 21. This case bears District Court No. 15929• OF COUNSEL LEAVITT R BARKER LELAND W. SCOTT HUGH K BARBER CABLE ADDRESS: DOROW The Village of Edina is named as defendant so as to determine whether or not a certain deed given to the Village in 1939 conveyed the South 2 rods of the property now platted as Fjeldheim Addition to the Village for public road purposes. The language of the deed is considered ambigious by the Examiner of Titles. However, in reviewing the file and the plat of Fjeldheim Addition, and in discussing the matter with the Examiner, it is our opinion that the platting of Fjeldheim Addition and the dedication by such plat of the same portion described in the deed of 1939 for public road purposes, being Dewey Hill Road on said plat, does away with the need of the Village to rely upon the 1939 deed for its public road use, at least as to the property being registered. The Village can rely wholly upon the dedication made by the plat of Fjeldheim Addition for its public road rights as to the land within the plat.
