OR fi �'UTY (1(3A) .w EASEMENT WHEREAS, the undersigned, ___ _____ __ ________________ _—_ and ___ _ _ _ -------------- -, husband and wife, are the owners of the premises herein er d cribed Isitluat in the Village of ina, County of Hennepin and State of Minnesota, and REA , said p are within what is known as "Joint Sewer District No. 1, Edina" hereto- fore cr ted in said Vge nd with others, the undersigned are desirous of having said joint sewer constructed and thereafter maintained for the service of their property. NOW, THEREFORE, in consideration of the premises and of the sum of One Dollar ($1.00) to us in hand paid, the receipt whereof is hereby acknowledged, we, the undersigned, hereby give and grant under the Village of Edina, a municipal corporationof the County of Hennepin and State of Minnesota a perpetual easement ten feet (10 ft.) in width and of the necessary depth for the construction, In- stallation, operation, maintenance and repair of a sewer in, under, over and upon the following deWxib- ed premises, to -wit: A strip of land 10 feet wide 5 feet on each side of a straight line running from a point on the 6outh line of the North 50 feet of the South 1/2 of SE 1/4 of the NE 1/4 of the NE 1/4 of Section 19, Township 28, Range 24, which is 585 feet West of the East line of said section 19 to a point on the North line of said South 1/2 of SE 1/4 of NE 1/4 of NE 1/4 which is 579 feet West of the East line of said Section 19. This easement is granted subject to agreement on the part of the Village of Edina that on.completion of the sewer across the property the Village shall to the extent reasonably possible restore the property to its original condition by replacing shrubs, fences, etc., fences to be erected plumb with posts solid and woven wire fencing P%U-ed',. ht -Woven wire fencing orb tk* north and south boundaries shall not be cutebut during construction of the sewer shall be rolled back and stretched across the lot with temporary posts so as to exclude dogs and other animals. e1 It is further agreed that the Village of Edina shall be responsible for any damage resulting from the actions or negligence of its Workmen, agents, or representatives, and shall compensate the owners of the property for any such damage. It is understood that the said sewer will be constructed and thereafter maintained as nearly as may be in the location upon said premises established or to be established by the engineer charge of the construction of said sewer.
