HomeMy WebLinkAbout586TRUNK SEWER EAST21 . from (' Federartl� Ixft tmm.t3 Co. to VILLAGE OF EDINA i I 1400 c; Deeds 264 etc. Eli I OF DEFLDS kfa I E 4 EASEMENT RPY, .S, the undersigned, FEDERAL IMSTliFPjT COMPANY, a Corporation under the laws of the State of Minnesota, is the owner of the premises hereinafter described, situated in the Village of Edina, County of Hennepin and State of Minnesota, and WEEREAS, said premises are within what is known as 'Joint Sewer District %o. 1, Edina," heretofore created in said Village and with others, the under- signed is desirous of hiving said' joint sewer constructed and thereafter main- tained for the service of its property. ,OW, THM. 013, in consideration of the premises and of the sum of One Dollar ($1.00) in hand paid, the receipt whereof is hereby acknowledged, the undersigned hereby gives and grants unto. the Village of Edina, a municipal corporation of the County of Hennepin and. State of Minnesota, a perpetual ease- ment ten feet (10 ft.) in width and of the necessary depth for the construction, installation, operation, maintenance and. repair of a sewer in, under, over and upon the following described premises, to wit; A strip of land 10 feet wide across Lot C in T'h.ite Investment Com- pany's Hidden Valley addition, said.. strip being 5 feet on each side of a straight line drawn_ from the point of intersection of the cen- ter line of Zenith Avenue South with the center line of West 55th Street to a point on the Westerly line of said Lot C which is 10 feet northeasterly measured along same from'thc:; most southerly cor- ner of Lot 8 in Block 2 of ?hite Investment Company's Hidden Valley addition; Provided that the Village of Edina by the acceptance of this easement hereby agrees to adequately waterproof said sewer and bac.h'ill so as to _prevent said sewer or the ditch in which it is laid from acting as a drain for the waters of Zdinnehaha Creek or the surface or sub - surface waters draining into said creek, and that it will not unreasonably divert the original course of said creek in the installation of said sewer. Any excavation made by the Village shall not be refilled until the undersigned shall be notified in writing and shall have had five clays within which to inspect said excavation. It is understood that the said. sewer will be constructed and thereafter maintained as- nearly as may be in the location upon said premises established or to be established by the engineer in charge of the construction of said sewer. � M \ IN TESTIMONY WMENOY, the undersigned has caused these presents to be executed in its corjaorate name by its President and its Secretary, and its corporate seal to be hereunto affixed, this second daft of august, 1939. '.Yghite and R.H.nn ite, to me personally known, who, being each by me duly sworn, did say, that they are each respectively the President and the Secretary of federal Investment Compares, the corporation named in the fore going instru- ment, and that the seal affixed to said. instrument is the corporate seal of said corporation, and the saic_ instrument was signed and sealed in be- half of said corporation by authority of its Board of Directors, and said H.W.I'Mite and R. H.
