EASEMENT FOR SANITARY SEWER
THIS INSTRUMENT, Made this 18th day of October _ , 19 57 , by
and between Alfred A. Gross and Irene M. Gross, husband and wife
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina;
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1..00) Dollars,, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey and Warrant to said party of the second part �n Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -witf
A Twenty (20) foot strip of land lying within the following described property:
Commencing Four Hundred Seventy -one and Five Tenths (471.5) feet East of the
Northwest corner of the Southeast Quarter (SE'J) of Section Thirty -one (31)9
Township One Hundred Seventeen, (117), Range Twenty -one (21); thence South
One Thousand Six Hundred Sixty -eight (1668) feet to the center of Eden Prairie
Road; thence Northeasterly(NEly) along said road a distance of Two Hundred
Ninety -seven (297) feet; thence Northerly (Nly) One Thousand Four Hundred
Eighty -six and Five Tenths (1486.5) feet to a point on the North line of the
Southeast Quarter (SE-41) distant Two Hundred Ninety -five (295) feet East from
beginning; thence Nest to beginning except road. The centerline of said
Twenty (20) foot strip of land begins at a point on the East line of Walnut
Ridge First Addition, said point being Thirty (30) feet North of the Northeast
corner of Lot One (1), Block Two (2), Walnut Ridge First Addition; thence
Easterly at right angles to said East line a distahce'of One Hundred Forty -
nine and Fifty -seven Hundredths (149.57) feet; thence Southerly at a deflection
angle of Ninety (90) Degrees right, a distance of One Hundred Twenty -five (125)
feet; thence Easterly at a deflection angle of Ninety Degrees (900) left, a
distance of Five Hundred Sixty -six and Seventy -five Hundredths (566.75) feet;
thence Southerly at a deflection angle of Ninety -two Degrees and Eleven Minutes
(92011') right, a distance of Four Hundred Fifty (4,50) feet, more or less, to
the North right -of -way line of State Highway ##169 -212.
Together with a construction easement on to the, land of Fifty (50) feet
from the centerline on the ',hest side of the North -South portion of the
easement, and Twenty -five (25) feet on each side of the centerline of the
East -West portion of the easement, which construction easement shall
cease and terminate upon completion of the sewer contract. r

It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
