Dear Bob:
Attached is a letter from Mr. Donald C. Lentsch, Attorney at
Law, 242 University Avenue, St. Paul, Minnesota, regarding Lot 1, Block
5 in Braemar Hills Second Addition. Apparently a title objection has been
raised as to the above lot, because of the existence of the agreement referred
to in the letter between F. J. Hays and wife and the Village of Edina. You
will see that that agreement relates to the purchase of the Hraemar property
by the Village. I presume that purchase has now been completed and the Village
has no interest in said Lot 1, Block 5 in Braemar Hills Second Addition. I
am not fully aware of the circumstances surrounding the acquisition of the
Hays property, but it is interesting to note that the description of the property
sold in paragraph 1 of the agreement covers property within Braemar Hills
Second Addition. The portion covered is shown in green on the attached map.
I can only presume that the Village purchased only that part of the area
colored in green which lies south of Braemar Hills Second Addition. However,
this should be checked. If my assumption is correct, I would see no reason why
the Village could not execute the requested quit claim deed. Please review this
matter and give me your comments.

Mr, Erickson:
I represent Mr. and Mrs. Richard E. Burton who sold the above property
to Donald J, Burris and his wife. Mr. Burris raised the question as to
the title because of an agreement dated November 13, 1956 between F. J.
Hays and Helen B. Hays and the Village of Edina to pux:chase certain
property9 wIich appears to affect the above property. This agreement
was filed of record on November 26,.1956 as Document #516678 in the
office of the Registrar of Titles for Hennepin County, For your in-
formation, I am enclosing a Registered Property Abstract which shows
the filed document to which I refer.
Mr. Burris had 'a conversation with Robert Obermeyer, the engineer for the
city of Edina, and he said that the agreement between the Hays and the
city of Edina does not effect the subject property, namely, Lot 1, Block
5 in Braemar Hills Second Addition.
I would appreciate it if you would look into the matter and our request
is that the city of Edina execute a Quit Claim Deed to Lot 1, Block 5
in Braemar Hills Second Addition to Donald J. Burris and Diana L. Burris,
Husband and wife as Joint Tenants.
If you have some questions regarding the matter, please contact me at your
earliest convenience.
