R E S O L U T I O N
WHEREAS, It is necessary, advisable and in the public interest
that the Village of Edina lay out and establish a street for public road
purposes, and
WHEREAS, In order to accomplish such purpose, it is necessary
to acquire an easement for street purposes in the following described
land, namely:
The West Thirty (30) feet of Lot Three (3), Block
Five (5) "Creston Hills Hennepin County, 11innesotall,
according to the plat thereof on file and of record
in the Office of the Registrar of Titles, which property
is owned by Oliver H. Bagg and Marion V. Bagg, husband
and wife, as joint tenants.
WHEREAS, the efforts of the Village of Edina to obtain such an
easement from the above owner have been unsuccessful, and
WHEREAS, the Village is advised and believes that the most
feasible location for such a street is on the land above described, and
WHEREAS, by reason of the failure of the Village to obtain such
an easement, it has become necessary to procure title to such land by
right of eminent domain,
NOW, THEREFORE, BE IT RESOLVED That the Village of Edina proceed
to procure an easement in the above described land under its right of
eminent domain and that the Village Attorney be instructed and directed
to file the necessary complain therefor and to prosecute such action to a
successful conclusion or until it is abandoned, dismissed or terminated
by the Village or by the court; that the Village Attorney, the President
and the Clerk do all things necessary to be done in the commencement,
prosecution and successful termination of such action. l

being first duly sworn, deposes and
says that he is the duly elected and qualified Clerk of the Council of the
Village of Edina; that at a regular meeting of the Council of the Village
of Edina held at the Edina Village Hall in the Village of Edina on
at which all of the members of the Council were present in
person, the resolution, a true and correct copy of which is hereto attached,
was duly adopted by the affirmative vote of all of the members of the Council
present at the said meeting. The aforesaid resolution, since its adoption,
has not been changed, amended or re caked.
