CityofEdina.com History on Residential Zoning Updates Similar issues were discussed in 2007 -08, with the following changes at that time: • Building height restrictions enacted, with a maximum of 35 -40' to the ridgeline. • Measured building height from existing grade rather than proposed grade. • New home's first floor elevation can only be a maximum of 1' higher than the existing home's floor elevation. • Increase of side yard setbacks on lots 50 -75 feet in width, on a sliding scale. • Eliminate bay window setback exception for home widths. Limiting residential FAR (floor /area ratios, which limits house sizes) was discussed but no action was taken by the Council. CityofEdinaxom Planning Commission Working Group, 1jrXV a .+ U Datt • Working Group started early November 2012 • City issued formal Construction Management Plan — December 2012. • Met with small stakeholder groups: residents, city staff, builders, relators • Reviewed resident letters /correspondence on issues. • Benchmarked national and surrounding city zoning ordinances. • Created and held residential public forums and city blog site for feedback. • Reviewed feedback to provide preliminary recommendations. Please note the following written and verbal comments by category. Zoning Ordinance Changes: • Suggestion to'aharrge' the ordinance for lots less than 5d -feet in width. Leave the rest alone. • Can the onf toe do somethig about yards being shadowed by l hese overly large homes (setback inaeasej. (this could be bolding too i` as part of the pernit application a shadow, study is required) • Access to the rear yard needs to be provided on each lot Ordinance requirement{ ?) • Reconsider bolding height 1 how would amt measure a fat roof? • Are there requirements regarding outbuidings (sheds) in terms of setback, sue. height? • Side setbacks are too small for small lots. Not enough room. • Address egress window, with setbacks. • Change or dkunce for lots less than 9.00D square feet or tot width under 60 — feet • Need setbacks for sheds — 2 -story sheds too dose to neighbor blocks sunlight • Tree preservation ordnance. • Increase setbacks on 50 foot wxde lots. • Setbacks — homes should Gne up. Worm across the street was allowed to be built further back on the lot. Sweet looks better when homes Gne up as in the Country Club. not all over the place. • Tree preservation. conservation — restrict cutting down trees — pro!.ert trees an property line — replace tree if removed and protect heath of existing trees. • Implement rewards for coned building practices. F-MSOrce existing codes. • Are comer lots treated djfemrrtdy than lots in the middle of the block Are comer lot setbacks Oferent. • Consider a limit on height of fences installed on top of re taining vralls. • Setbacks for egress windows for lots 50-feet of less — the window well cannot impede neighbor's access to their ohm backyard ( ?) • Need setback requiements to address light and space impact on adjacent homes. • Suggest that a 'FAR' be set at no more than 2 -arses the existing house 'footprint' excluding garage avowed on the lot A FAR like this would lim`t the height of 'Monster' smed houses. • 60-Soot lots need diffe m specs than target lots. • City should follow rules in place. • Identify and define neighborhood character for each neighborhood. CityofEdina.com Engsteering • Instead of changina the ordinance consider the 'problem of overly large houses that znpact everyone in the Qty. not only Momingside (i.e. wa'--r runoff require that vrater runoff be directed to the street). • Require soil testing (this could also belong in the building permit area or consumton management) • also t ubry prt result construction vehicles usirta road (This would • Water runoff from a3 sides must go to the street — this rust be enforced. • Sturn water drainage and enforcement by ehosUV ordnance. • Rainwater comes o5 the neighbor's roof acrd flows into cry yard. • En!broe water twof requirements— its currently not enforced. • A real concern for drastage problems — especia2y in South Hamel Park where lots are Mfeet wide. • Make sure water gram new house drains into the sheet. Construction Management Plan: • Vibrations from construction machinery — is the builder responstre for issues or damage to neighboring homes. • No response from the City after mmpL"t is registered. • Can hours of construction be re- renewed. • Should there be standards regarding vbraton during construction. • Geodtermal instal. • Have builders take so] samples to know possible impact on neighboring homes (thy could W under building pern ts.'engheering retriew) • Crewe defin;*e consequences for code volations for builders. We paid for our new streets about 4 -years ago. Now the new construction vehicles are destroying them. Is there any recowse? Redkeet the exhaust from construction equipment • Oacnage done to home next door due to new construction or from demolition, can the City require that the builder place monies in esaoor for repair to neighbor's property. Require proof of inspection (by the City) prier to construction, after demolition and alter construction. • Currently no aonsequeruoes when develiopers violate codes. • Requ'ae pre. oiling and post construction inspection • Hie more staff— too rtarty teardowns for current stag to keep up wide • There should be a parking Om for each new house bua'L I am constantly asking people to move the!r vehicles so t can get out of my driveway. • If a home owner inquires about construction issues — can City respond in writing to them, and not just send written notice to contractorfremodeler and owner. Workshop Notes . p • Require a damage deposit from developers. • Require soil testing for new construction. Aesthetics: • Front loaded garage WC that are greater than 30'. of the front facade are too much for our neighborhood. • No va5re to the context of the neighborhood when building new homes. Trees: • loss of trees — seems replacement pLuAings are often just shrubs and omarnentS trees. • Tree loss from construction occurs and on top of the Dutch elm and tee loss due to old ape — the majority of tees have life expectancy of 50 + years and many were planted 50 + years ago. • Builder promsed to build up 39 around ail the tees on the tot and he ended up tufting down ai four trees on the IoL He proceeded to bald a house that completely shades the sw! h side of my house. • Damage to neighbors trees. • Seen abuse of trees Mat are tea standing during construction: only to d`.e a slow death. • Can Edina create a tree ordnance. Idle trust w h the Cy - City seems to favor builders. • Re-review the construction noise loran. • Get professionals who wolf an the current home owners behalf not the builders M • Need peopte who are skilled in conflict resohrtion1faciitators. • Urban plxwfrq designers. • Snow slides cff the roof of the new house onto my steps of my side door on my property. • Are specula ors buying up properties before pmspeave buyers have a chance to buy into an affordable neighborhood. • Couid not get explanation for why City required changes to plans. • Issue of d'dWernce in size of new hone when compared to original home. • Losahg affordable suer hones to builders. They seem to coddle builders and they have fajorites. I am not convinced that building inspectors hdd builders to the Code. • Asking builders to help far the problem is Ike asking the fox to guard the hen house. • Can building razerais for re =crag walls be regulated to prevent premature bowv:mg or disrepair • Need teeth for code violations. • Education document— maintain'dw=teP = more home vaVe— Possibly in-. pence new construction wth economics. • Does Edna support existing homeoKowers wvth Iew cost remodel loans like St Louis Park does to upgrade exist' V homes. • Not want lenders Come home to Edina Program for first time homeowners.( ?)
