a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no/100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as

We enclose herewith an original and one copy of an easement
for drainage ditch purposes over a tract of land in the Southeast 1/4
of the Northwest 1/4 of Section 5, Township 116, Range 21, given by
The Normandale Corporation.
A like easement was also recently sent to this office for
recording, which easement was given by the present fee owner, one
Peterson. That easement has been recorded on Certificate of Title
No. 315116. The enclosed easement, however, is not acceptable for
recording because the grantor therein is only a contract buyer of
the property and the contract for deed is not of record.
I suggest, therefore, that you hold the enclosed easement
in your files. The easement of record from the present owner is
sufficient indication and evidence of our right to the drainage
easement.

WITNESSETH, That the said party of the first part, in consideration
of One and no/100 (1,00) Dollars, to it in hand paid by the said party of the
second part, the receipt whereof is hereby acknowledged, does Grant, Bargain,
Sell, Convey, and Warrant to said party of the second part an Easement in per-
petuity for storm sewer purposes, including the right to enter for the purpose
of constructing, maintaining, altering, repairing, and reconstructing a storm
sewer system in, under, and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wits A drainage ditch ease-
ment in and over a tract of land lying in the SE 1/4 of the NW 1/4 of
Sec. 5, T- 116 -N, R -21 -W; said tract to consist of the westerly 100.0
feet for construction purposes and the westerly 30.0 feet for
permanent easement purposes of the said quarter - quarter; extending
from the North Line of the South 1155.0 feet of said quarter - quarter;
southerly a distance of 450 feet, more or less, to the centerline of
Nine Mile Creek; and there terminating.
Provided, however that the easement for construction purposes shall terminate on
June 30, 1961.
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation* it is further agreed by the party of the second part
that earth removed from the open ditch shall be used to form dikes on each
side of ditch and parallel, to ditch centerlines lasegao as as
