THIS INSTRUMENT, Made this Zkst day of C4dc-k"-_l9_1P0, by

a corporation under the laws of the State of Minnesota, party of the first
part, and the Village of Edina, a municipal corporation organized under
the laws of the State of Minnesota, party of the second part;
WITNESSETH, That the said party of the first part, in consideration
of One and no /160 (1.00) Dollars, to it in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, does
Grant, Bargain, Sell, Convey, and Warrant to said party of the second

together with removing all trees upon the following described property
situate in the County of Hennenpin and State of Minnesota, to -wit: A
slope easement in and over a tract of land lying in the NE 1/4 of the
NW 1/4 of Section 5, T- 116 -N, R -21 -W, said tract to be 42 feet in width,
and is more particularly described as follows: The easterly 75 feet
of said quarter - quarter extending from the south right -of -way line of
Whiting Street extended,northerl.y for a distance of 300 feet and there
terminating, excepting a 33 feet road right -of -way for Tracy -blinge4 Ave.
It being a condition of the said easement that the earth matter removed
from this excavation shall be deposited in an area approximately 750'
south of thelgbrtli, Line of the NW 1/4 of said section lying south of
land owned by the Village for Park purposes.
It is the intention and agreement of the parties hereto that the
party of the second part shall in the construction replace any sod removed
by the excavation, in as nearly as possible the same condition as before
such excavation
