Gentlemen:
We have inquired into the "Order to Show Cause" served
on you relative to the removal of a right-of-way easement over
the South 198 feet of the East 440 feet of the Northeast Quarter
of the Northeast Quarter of the Northwest Quarter of Section 29,
Township 28, Range 24. The Certificate of Title for said property
has memorialized thereon an easement to the Village of Edina over
the Northerly 30 feet thereof. This easement is an extension of
Heritage Road as laid out in the plat to the West of said property
and there appears to be no road along the South 15 feet of said
property.
Therefore, based on our examination of the map and
Certificate, and pursuant to Mr. Hite's letter on this subject
of November 24, 1961, we recommend that no appearance be made at
the time specified in the Order to Show Cause. The Village
apparently has no need of the easement over the South 15 feet of
the subject land, and the easement over the Northerly 30 feet with
the extension of Heritage Road is not affected by the Procee4-J .

and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 Dollars ($1.00), to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for public road purposes, in, under, and over the following
described property situate in the County of Hennepin and State of Minnesota,
to-wit:
The North 30 feet of the South 198 feet of the East 440 feet of the
Northeast 1/4 of the Northeast 1/4 of the Northwest 1/4 of Section
29, Township 28, Range 24. (The Northwest and the Southwest corners
of said tract are marked by Judicial landmarks set purusant to
Torrens Case No. 10266, and the Northeast corner of said tract is
marked by a judicial landmark on the North line of said tract 31
feet West of the Northeast corner thereof, and a judicial landmark
is set on the South line of said tract 221.1 feet West of the
Southeast corner of said tract.
