POWERS and DOROTHY',POWERS, husband wife, of the County of Hennepin and State of Minnesota, parties of the first part, and the Village of Edina, a municipal corporation organized under the laws of the State of Minnesota, party of the second part, WITNESSETH: WHEREAS, parties of the first part own title to the following described property situate in the County of Hennepin and State of Minnesota, to wit: Lot 31 Block 2, "Miller's Addition," Hennepin County, Minnesota, according to the recorded plat thereof. AND WHEREAS, party of the second part desires an easement over said property for the purpose of storage of water. NOW, THEREFORE, for and in consideration of $1.00 and other good and valuable consideration, the receipt of which is hereby acknowledged, the parties of the first part do hereby grant, bargain, sell, convey and warrant to the party of the second part, an easement in perpetuity for the purpose of storage of water over those parts of said first described property des- cribed below, which parts are hereinafter called Tracts A and B, including perpetual rights to excavate, construct, maintain and repair a reservoir to contain water on said Tracts A and B, and parties of the first part their successors and assigns, agree not to deposit any fill in or on said Tracts A Tract A and B are described as follows, to -wit: TRACT A Commencing at the Southeasterly corner of said Lot 3; thence Northeasterly along the Southeasterly line of said Lot 3, 30 feet; thence Northwesterly to a point on the Westerly line of said Lot 3 distant 50 feet Northerly from the Southwesterly corner thereof; thence Southerly to the Southwesterly corner of said Lot 3, thence Easterly along the Southerly line of said Lot 3 to the point of beginning and there terminating.
