a municipal corporation organized under the laws of the State of Minnesota,
party of the second part,
WITNESSETH, That the said party- of the first part, in considera-
tion of One and no/100 (1„00) Dollars, to ;:her in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:

of which is described as follows:
Commencing at the intersection of the centerline of Cleveland
Avenue in Cleveland's Subdivision of Emma Abbott Park and the
south line of the vacated Minneapolis, St. Paul and Suburban
Railroad; thence north along the centerline of said Cleveland
Avenue extended to the north line of the vacated Minneapolis,
St. Paul and Suburban Railroad and there terminating.
Subject to and with the reservations reserved to the first party, her heirs and
assigns, as follows:
(a) All rights of access, ingress and egress over and across
the land above described for which this easement is given.
(b) All rights to the use of the above described land for which
this easement is given for all purposes, except that no
building or buildings shall be constructed thereon, and

Re Lots 17, 18 and 19 of Emma Abbott Park
Dear Bob:
A while ago, the City of Edina was served with a summons in a
Torrens proceeding. The Torrens proceeding was instituted by Brookside 1,
a limited partnership for the purpose of clearing up some title problems
on "Lot 3, Block 1, Dietrich's Brookside Court, except that part of said
Lot 3 which lies North of the center line of that part of vacated Motor
Street which lies North of Minneapolis, Lyndale and Lake Minnetonka Railway."
The area within the registration proceeding is that outlined in yellow on
the attached map,. The City of Edina was named as defendant in that procee-
ding because of the ambiguous legal description in the conveyance by the
Dietrich Co. to the Village of Edina dated November 1, 1967 and filed in
Book 2611, page 374, as Doc. 3685953. That deed conveyed the area in blue
on the enclosed map, but also contains language that appears to have no
relationship to the description of the area colored in blue. Also, in
checking the matter with your office, we found that you do not have a copy
of the deed dated November 1, 1967 from the Dietrich Co., and that your
ownership records do not indicate that you own the portion of the abandoned
railroad right -of -way lying South of Lots 17, 18 and 19.
After reviewing this matter with Mr. Obermeyer in your office, and
reviewing the enclosed deeds, we concluded that the city had no interest in
the property being registered in Lot 3, Block 1, Dietrich's Brookside Court
and therefore have not answered the proceeding. The registration proceeding
will, however, subjectr'said Lot 3 to the.storm sewer and drainage easement
shown on the plat of Dietrich''s Brookside Court,to the utility and drainage
easement shown on the plat anal to a storm sewer easement in favor of the city
over the West 10 feet of Lot 5 as granted in the document recorded in Book
2349 of Deeds, page 574, Doc. °3354476.

To complete your title documents on this property, I have obtained
and enclosed herewith a certified copy of the deed on the Dietrich Co. dated
November 1, 1967. Also enclosed is a copy of the deed Doc. 3354476 granting
the.storm sewer easement over a part of Lot 3. You may already have the
latter document, but I thought I would send it to you for your file.
If you have any questions concerning the above matter, please
advise.

P.S. It is interesting to note that Blocks 17, 18 and 19 Emma Abbott Park
are Torrens property and the owner's duplicate.certificate of title,
No. 443022, is, I believe, in the city files. The additional deed enclosed
herewith from.the Dietrich Co. and dated November 1, 1967 was filed in
the abstract records, not the Torrens records and appears to be an additional
conveyance of the same property as is within the owner's duplicate certifi-
cate of title but in addition, also conveys the abandoned right -of -way lying
to the South of Lots 17, 18 and 19. TSE
