EASEMENT
THIS INSTRUMENT, Made this 1st day of July, 1963, by an.
between WALTER H. FINK and CECILIA V. FINK, husband and wife, also known
as Walter Henry Fink and Cecilia Virginia Fink, of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second party

WITNFSSETH, That the said parties of the first part, in consid-
eration of One and No /100 Dollars (*1.00), to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
a
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Basement in perpetuity for all utility and drainage purposes
including, but not being limited to, sanitary sewer, storm sewer, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
The easterly ten feet (101) of the westerly thirty feet (301) of -Lot 9,
and the northeasterly ten (10) feet of that pert of Lot 6, lying Southwesterly
of a line drawn from a point on the southeasterly line of said Lot 8, distant
32.09 feet northeasterly from the southwesterly corner thereof, to a point
on the west line of Lot 8, distant 81.58 feet north of the southwesterly
corner tie reof,
Block 2, Hilldale, Hennepin County, Minnesota, according to the plat thereof on file
and of record in the office of the Register of Deeds in and for Hennepin

Together with a tempos construction easement fifteen feet (159
in width on the west side of and parallel to the above described
ten foot (101) util3;ty easement,4 said temporary easement shall
cease and terminate on January 1, 1954.
This instrument is exempt from state deed tax.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction,,or maintenance
of said utility and drainage systems replace any shrubs or " removed
by an excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
