Heffelfinizer and Marcia M Heffelfi.nger, husband and wife , of the County of Hennepin and State of Minnesota, parties of the first part, and the Village of Edina, a municipal corporation organized under the laws of the State of Minnesota, party of the second part; WITNESSETH, That the said parties of the first part, in considera- tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, do Grant) Bargain, Sell, Convey and Warrant to said party of the second part an Easement in perpetuity for sanitary sewer purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing a sanitary sewer system in and over the following described property situate in the County of Hennepin and State of Minnesota, to -wit: A permanent ten foot (101) wide easement through Lot 3, Auditor's Subdivision No. 319 and Lot 9, White Oaks 6th Addition, the center line of which easement is described as follows: Beginning at a point on the east line of said Lot 9, six feet (61) southerly of the northeast corner of said Lot 9; thence westerly to a point which is five feet (51) southerly of the northerly line of said Lot. 9 and five feet (51) east of the west line of said Lot 9, both measurements being at right angles to said lot lines; thence westerly to a point in the southeasterly line of Townes Road Circle, which point is nine feet (91) southwesterly from the most northerly corner of said Lot 3, Auditor's Subdivision No. 319. Also temporary construction easements as follows: A twenty foot (201) wide strip of land lying southerly of and abutting the above described permanent easement and lying between the east and west lines of said Lot 9. A twenty -five foot (251) wide strip of land lying southerly,of and abutting the westerly eighty feet (801) of the above described permanent easement within said Lot 3 and extending westerly to the southeasterly line of Townes Road Circle. Said temporary easements shall terminate on December 31,'1964. It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said sanitary sewer replace any shrubs or sod removed by any excavation in connection with such construction or maintenance work, in as nearly as possible the same condition as before such excavation.
