THIS INSTRUMENT, Made this 5 thday of September , 1cfi 3 , by
and between Calvin R. Coo-oer and Ruth V. Cooper, husband and wife
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consid-
eration of One and No /100 Dollars ($1.00), to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity for all utility and drainage purposes
including, but not being limited to, sanitary sewer, storm sewer, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
The westerly tIitrty feet .(50t) of the northerly three hundred ten feet
(3101) and all of the north thirty feet (301) of the following described
property:
Co=rning at a point in the Nest line of the southeast 1/4 of the
northeast 1/4 of Section 29, Township 117, Range 21, distance twenty -six
and twenty -four hundredths (26.24) rods north from the southwest corner
thereof; thence north along said west line twenty -four and twenty -four _
hundredths (24.24) rods; thence east parallel with the south line thereof
three hundred ninety -four and five tenths feet (394.5'); thence south one
hundred twenty -four and ninety -six hundredths feet (124.961) parallel with
said Nest line; thence east one hundfred fifty feet (1501) parallel with
said south line to the west line of Cooper Avenue; thence south along said
street line twenty -five feet (251); thence west parallel with said south
line one hundred fifty feet (1501); thence south two hundred fifty feet
(2501) parallel with the west line of southeast 1/4 of northeast 1/4;
thence west three hundred ninety -four and five tenths feet (394.51) to
beginning.
Together with a temporary construction easement twenty feet (201) in
width on the east and south sides of and parallel to the above described
utility easement, said temporary easement shall cease and terminate on
January 1, 1964.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage systems replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
This instrument is exempt from state deed tax.

southeast 1/4 of the northeast 1/4 of Section, 29, Township 117,
Range 21.
Together with a temporary construction easement twenty feet (201)
in width on the south side of and parallel to the above described
