CLASS "C" LAND EXCHANGE
Issued Pursuant to M.S.A. 94.342 and 94.343.
KNOW ALL MEN BY THESE PRESENTS, THAT
WHEREAS, The land hereinafter described is Class "C"
land owned by the State of Minnesota, and the exchange thereof
was unanimously approved by the Minnesota Land Exchange Commission
on April 14, 1966, pursuant to the applicable provisions of the
State Constitution and statutes, and The Village of Edina, a
Municipal Corporation under the laws of the State of Minnesota,
having fully complied with all the terms and conditions of the
proposal for exchange approved as aforesaid on its part to be per-
formed, is now entitled to a conveyance of said land from the State;
NOW, THEREFORE, In consideration of the premises and
pursuant to the statutes in such case made and provided, the State
of Minnesota does hereby grant, bargain, sell and convey unto the
said Village of Edina, its successors and assigns Forever, the
following described land situated in the County of Hennepin, State
of Minnesota, to -wit:
The bed of existing Nine Mile Creek channel described
as: Commencing at the center of Section Thirty -one (31),
Township One Hundred Seventeen (117), Range Twenty -one (21);
thence on a bearing of south along the center line of said
section a distance of 245 feet; thence on a bearing of east
a distance of 140 feet to the actual point of beginning of
the center line of a strip of land 5 feet wide; said center
line described as follows: thence South 21041r East a dis-
tance of 490 feet; thence North 470501 East a distance of
335 feet and there terminating,
subject to the following:
(1) Reservations to the State of Minnesota of all minerals
and mineral rights and all water power rights on said land as pro-
vided by law;
(2) Prior mineral reservations of record and roadways
and easements of record;

(3) M.S.A. § 110.31, where applicable.
Consideration includes the exchange of lands herein
conveyed for the following described land in Hennepin County:
The bed of proposed new channel of Nine Mile Creek
described as: Commencing at the center of Section Thirty -
one (31), Township One Hundred Seventeen (117), Range
Twenty -one (21); thence on a bearing of south along the
center line of said section a distance of 245 feet; thence
on a bearing of east a distance of 140 feet to the actual
point of beginning cf the center line of a strip of land
10 feet in width; said center line described as follows:
thence South 61045,461' East, a distance of 487.19 feet
and there terminating.
TO HAVE AND TO HOLD THE SAME, Together with all the heredita-
ments and appurtenances thereunto belonging or in anywise appertaining,
unto the said Village of Edina, its successors and assigns, Forever.
IN TESTIMONY WHEREOF, The State of Minnesota has caused
this conveyance to be executed in its name by the Commissioner of Con-
servation at the City of Saint Paul, County of Ramsey, and State of
Minnesota, this day of July, 1966.

245 feet; thence on a bearing of East a distance of 140 feet to the actual
point of beginning of said center line; thence South 61 degrees 45 minutes
46 seconds East a distance of 487.19 feet and there terminating.
The purpose and intent of this deed is to release to Village of Edina all rights of
reverter and revestiture in the above described premises, which rights were retained
by party of the first part in that certain Warranty Deed conveying the above described
parcel and other lands, which deed was dated July 17, 1964, and filed for record
July 27, 1964, in Book 2451 of Deeds, page 287, etc. Tt is further the purpose and
intent of this deed to express the consent and approval of party of the first part to
a conveyance by Village of Edina of the above described strip of land to the State of
Minnesota for use as the bed of Nine -Mile Creek, and further to state that such convey-
ance for such use does not in any way violate or conflict with the conditions of use
imposed upon such strip of land by party of the first part in the aforesaid deed.
This deed is executed and delivered by party of the first part and accepted by Village
of Edina with the understanding that its effect is strictly limited to the strip of
land as hereinabove described, and that the terms and provisions of the Warranty Deed
dated July 17, 1964, hereinabove referred to, shall remain in full force and effect as
to the balance of the premises described in said Warranty Deed.

Dear Mr. Hyde:
A public hearing has been scheduled as required by law for
land exchange No. 177 between the Village of Edina and the State
of Minnesota, on February 15, 1966, at 10:00 A.M., in Room 302,
Centennial Building, St. Paul, Minnesota. It is not deemed
necessary that a representative from the Village of Edina attend
this hearing unless you particularly wish to do so.
Following this hearing, land exchange No. 177 will be pre-
sented to the State Land Exchange Commission.

Dear Mr. Hyde:
Enclosed herewith is a warranty deed for
execution by authorized public officials of the Village
of Edina, conveying certain land to the State of Minnesota
in connection with the above entitled land exchange.
After the deed has been signed, witnessed and
acknowledged, it should be returned to this office to
be checked, after which it will be recorded in the office
of the Register of Deeds and the abstracts continued to
date. It will be necessary that all taxes, special
assessments and ditch liens be paid in full before the
deed can be recorded.
Also enclosed herewith is an affidavit as to
occupancy and mechanics' liens which should be executed
and returned with the deed.
When these steps have been completed, the deed
from the State of Minnesota will be executed and forwarded
to you.

This is to acknowledge receipt of your land exchange application in
which you propose to exchange land you own described as:

The Land Exchange Commission's policy is to confine exchanges for the
present time at least to only such lands as affect consolidation of state
owned land within the boundaries of state forests, conservation areas and
projects now established or contemplated.
In case this exchange is consummated, we wish to advise that since there
are no monies appropriated for furnishing abstracts of title, the state can
furnish only the abstracts for state land that are available. In the event
that an abstract for state land is not available, such abstract must be ob-
tained at the applicant's expense.
We will contact the various divisions of the Department of Conservation
to ascertain if they have any interest in or objections to this exchange as
you propose. You will then be further notified.

We enclose herewith for review by your office the follow-
1. An Abstract of Title certified to October 6,
1965, at 7 :00 A.M., showing the title to cer
tain property in the Village of Edina involved
in the above- described land exchange.
2. A photocopy of the original deed from the for-
mer owner of the premises to the Village of
Edina, which photocopy sets forth the restric-
tions on the use of the property.
3. A photocopy of a Quit Claim feed from the farmer
owner of the premises to Village of Edina, which
photocopy nets forth the release of those restric-
tions as they pertain to the portion of the premi-
ses to be deeded to State of Minnesota for stream
purposes.
I assume that you will review the same and give an a copy
of your opinion on the matter.

I am forwarding to YOU a letter Warren Hyde received from the State Land
Management Section. This letter pertains to a proposed exebange of land
between the State of Minnesota and the Village of Edina for the purpose
of relocating a segment of Wine Mile Creek. I believe John Taylor, of
Your office}, has been involved in this.
DIn the state's letter they ask for our consent to a change in the des-
dription of the land being exchanged, which change would modify the
width of the creole bed from ten (10) ;feet to five (5) feet. We have no
objection to this change.
Another paragraph of the State's letter relates to a problem in the deed
to one of the properties involved. This is a scatter that your office
will have to take care ref.
Please see that the State is provided with the information and assistance
they request. I am enclosing a copy of the +Gleoson's addition plat for
transmittal to the state in accordance with their wishes. Thank you.
