RE: Storm Sewer No. 95
We recently sent to the Village of Edina, Owner's Duplicate
Certificate of Title No. 401122, which covered the property recently
acquired in fee from Berglund, in the Storm Sewer No. 95 area. The
deed which conveyed that property to the Village also contained a
perpetual easement over a portion of Lot 11in Willard's Subdivision of
Block 17, Mendelssohn. The original of that deed is retained in the
Office of the Registrar of Titles, but I thought you might like to have
a copy of it for your file. I, therefore, enclose: herewith a copy
of that deed. This deed is not signed,but, as staged, the original is
in the Office of the Registrar of Titles. The original was also recorded
in the Office of the Register of Deeds as Document No. 3592209. Should
you want a certified copy of that deed, it can easily be obtained and I
will be happy to obtain one if you desire. However, the enclosed copy
might be adequate for your purposes. The description contained in this
deed which is not contained in your Owner's Duplicate Certificate of Title
No. 401122 is that bracketed in red. The other properties were also
conveyed but are Torrens property and, as stated, contained in said
Certificate of Title.

parties of the first part' and the Village of Edina, a municipal
corporation of the County of Hennepin and State of T4innesota., party
of the second part;
WITNESSETH,, That the said parties of the first part, in
consideration of One and no/100 (1900) Dollars, to them in hand paid
by the said party of the second part, +ffie receipt whereof is hereby
acknowledged,, do Grant, Bargain, Sell and Convey to said party of the
second part an Easement for the purposes hereinafter set forth, in and
over the following described property situated in the Village of Edina)

The utility easement is the west ]A feet of the above described property.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utilities, replace the surface after any excavation in connection
with such construction or maintenance work, in as nearly as possible the
same condition as before such excavation.
The duration of this easement shall be perpetual.
The parties of the first part hereby covenant and warrant
that they have good title to said real estate and that they will warrant
and defend the said easement and the enjoyment in use thereof to the party
of the second part; and the parties of the first part make that warranty
for themselves, their heirs and assigns forever*
