By Deputy. <_ �:oy Department of Taxation - Form No. 966 (Public Use) STATE OF MINNESOTA DEPARTMENT OF TAXATION CONVEYANCE OF FORFEITED LANDS (Issued pursuant to Minnesota Statutes, Section 282.01, Subdivision 1) THIS INDENTURE, made this 6th day of January 19-62, between the State of Minnesota, as party of the first part, and Village of Edina., a Municipal Corporation as party of the second part, WITNESSETH: WHEREAS, the land hereinafter described was duly forfeited to the State of Minnesota for the non- payment of taxes, and, WHEREAS, pursuant to Minnesota Statutes Section" 282.01, Subdivision 1, the party of the second part has applied to the Commissioner of Taxation for the conveyance of lands hereinafter described to be used by it exclusively for utility and ponding purposes and, WHEREAS, the Board of County Commissioners of the County of HENNEPIN , State of Minnesota, has recommended to the Commissioner of Taxation by resolution adopted on the 27th day of December 19_6E, that such conveyance be made, NOW, THEREFORE, The State of Minnesota, pursuant to said laws and in consideration of the prem- ises, does hereby grant, bargain, sell and convey unto the party of the second part, forever, all the tracts or parcels of land lying and being in the County of HENNEPIN , State of Minnesota, described as follows, to -wit: Lot Six (6), except the Easterly One Hundred Forty (140) feet thereof, "El Rancho Addition" according to the recorded plat i thereof, Hennepin County, Minnesota TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and appurtenances there- unto belonging or in anywise appertaining, to the said party of the second part so long as it shall con- tinue to use said land for the purposes aforesaid, and upon condition that if such use shall cease said land shall revert to the party of the first part as provided by law. If was your understanding that the Village held the ownership of those lots pursuant to a tax forfeiture. Please be advised that the Village presently owns only that part of Lot 6, "El Rancho Addition" lying west of the easterly 140 feet thereof. The Village does not own any part of Lot S, nor the easterly 140 feet of Lot 6. Lot 5 is owned by one Sivert E. Olson and Henry A. Anderson and has been forfeited to the State of Minnesota for non - payment of taxes. The easterly 140 meet of Lot 6 is owned by Albert A. Teeter, Jr. and Mary Ryan Teeter, husband and wife. It is my understanding that the property owned by the Village, Navin- been acquired for utility and. ponding purposes, is still needed by the Village for those purposes and is, therefore, not available for sale.
