RELEASE
In consideration of the p%yment of the sum of Thirty -five
($35.00) Dollars by the Village of Morningside to the undersigned
Clara Dicke Parsons and E. Dudley Parsons, her husband, the receipt
whereof is.hereby acknowledged, the undersigned hereby release and
forever discharge the said Vi]lage of Morningside and its successors,
officers and agents of and from all claims and demands whatsoever
for damages to the following described pro�perty which they now have
or may have, whether at this time known or unknown, caused by rain,
snow, surface water or water from any source whatsoever, by reason
of the fact that no culvert has been placed by the Village A the roadway on Alden Drive opposite the property Derain described; it
being understood, however, that said Village does not.admit any
liability for any damage by reason of the absence of an such
culvert. The property involved and owned by the undersigned gned being
described as follows
South ninet (90) feet of Lot 56, Lot 57, North
one —half (j� Lot 58, Morningside, Hennepin Count ,
Minnesota, according to the recorded plat thereoY.
This agreement shall run with the above described
pmoperty and shall be binding upon the undersigned, their.heirs,
representatives, and assigns forever.

This correspondence memorializes our telephone conference of November 2,
1977, wherein I, as attorney for petitioner, and you, as attorney for the City
of Edina, in reference to paragraph 4 of the Report of the Examiner in the
above captioned matter, agreed that the land is subject to an easement in
favor of the City of Edina and, therefore, the subject clause of the Decree
should contain the following statement:
To an easement for storm sewer purposes in favor of the
City of Edina over the South 25 feet of Lot 25, as contained
in instrument filed as Hennepin County Recorded Doc. No.
4274679.
