Dear Mr. Erickson:
DeEtt Allen of your office requested that we send you
the storm drain agreement dated November 7, 1945, be-
bween Margaret M. Anderson and Merle 0. Anderson and
the Village of Morningside; also the agreement dated
May 27, 1942, with Village of Morningside and The
Minneapolis and St. Paul Suburban Railroad Company
for drainage pipe from France Avenue and 44th Street.
It is our understanding that the above two agreements
with the original signatures on them are required in
order that you can have them recorded. Would you
kindly have a recorded copy returned to us for our file.

the first part, and the Village of vrain� aide, Hennepin County, Min-
nosota, party of the second part, WIT'NESSETH;
The said Andersons, who are the fee owners of the land hereinaftor
descri ed, in consideration of the Sum of TOn Dollars (410.00), re.
ceipt whereof is hereby acknowledged, hereby convey to said Village
i;qe right to construct, maintain and repair a storm drain over the
northwesterly Ten (10) feet of Lot Four (4)0, and the Northwesterly
Ten (10) .feet of the Northeasterly Forty (44) feet of Lot Five (5),
all in Blocs One (1), of Fairbairn =s ioarrangemont, in the Village
of +►orningside, Hennepin County, MU.nnesota
It is understood that if and when said Andeisons fill in said
lot so that such drain may become covered, that the Village may lay
proper drainaGe pipe so that the d.r€ inaZe will not be interfered with

fort to notify the Village before such "filling is done so that the
Villaga may lay such pipe where the filling will be placed.
2=he Village agrees to indemnity said Andersons from any claims
wyiatsoever by reason of the laying, maintenance or repair of such drain.
This agreement shall be binding upon the parties hereto, their
heirs and assigns or successors, and shall run with the land.
