as beginning at a point on the north line thereof 1067 feet West along said
North line from the Northeast corner of said Government Lot 3; thence West
along said North line 275 feet; thence South parallel to the Bast line of
said Government Lot 3, a distance of 480 feet; thence East parallel to said
North line 275 feet; thence north parallel to said East line 480 feet to the
point of beginning. All according to the United States Government Survey
thereof, Hennepin County, Minnesota.

of the second part shall in the construction, or maintenance of sai,^ storm sewer
replace any shrubs or sod removed by any excavation in connection such con-
struction or maintenance work, in as nearly as possible the same as
before such excavation.

I enclose herewith an original and two copies of a
Stipulation in Torrens Case No. 15758. This has been fully
executed by Harold I. Kenney and Grace M. Kenney, the applicants
in the registration proceeding. This is now to be signed by the
Village. Will you please see to the execution of this instrument
by yourself, as Clerk, and Arthur Bredesen, as Mayor, have it
duly witnessed and acknowledged and returned to me. I will then
see to its filing and delivery.

The easement for storm sewer referred to in the Stipulation
I have in my file and am now in the process of recording the same. This
easement runs over the North 120 feet of the West 20 feet of a part of
Government Lot 3, Section 4, Township 116, Range 21 now owned by the
Kenneys. We have been waiting for this easement for quite some time
from the Kenneys. They delayed giving it to us because of the registration
proceeding but have now granted it and we axe seeing to its recording.
I am sending a copy of this letter to Ray Drake for his information, to-
gether with a copy of the stipulation and easement form.

WHEREAS., Harold I. Kenney and Grace M. Kenney, husband and wife,
hereinafter called "Applicants", are registering title to certain land in
Hennepin County, Minnesota, described in Torrens Case No. 15758, Hennepin
County, Minnesota; and-

WHEREAS, said Applicants have by document dated 1966,
conveyed an easement for storm sewer purposes to the Village of Edina over the
North 120 feet of the West 20 feet of the property described in said Torrens
Case No. 15758, a copy of which easement is attach4d hereto as Exhibit A and
hereby made a part hereof.
NOW, THEREFORE, For and in consideration of the granting of said
'
easement to the Village of Edina, the Village of Edina does hereby agree that
no I notice of any kind need be given to or served upon it in connection with
said registration proceeding and that a decree of registration may be entered
in the above entitled registration proceeding without any or farther notice to
it, provided, however, that said land be I registered subject to said storm sewer
easement granted to the Village of Edina and that the easement to the Village
of Edina be shown as a memorial on the Certificate of Title to be issued pursuant
to said registration-proceeding.
