and between EDINA PLAZA CORPORATION
a corporation Heider the laws of the State of Minnesota, party of the first
part, and the Village of Edina, a municipal corporation organized under
the laws of the State of Minnesota, party of the second part;
WITNTESSETH, That the said party of the first part, in consider-
ation of One and No /100 Dollars ($1.00), to theta in hand paid by the said
party of the second part, the receipt whereof is hereby acknowledged, do
Grant, Bargain, Sell, Convey and Warrant to said party of the second part
an Easement in perpetuity for all utility and drainage purposes including,
but not being limited to, sanitary sewer, storm sewer, water pipes, in-
cluding the right to enter for the purpose of constructing, maintaining,
altering, repairing and reconstructing said utility and drainage syste=
in and over'the following described property situate in the County of
Hennepin and State of Minnesota, to -wit:
A strip of land, 20 feet in width, located in Lots 8
and 9, Block 5, Edina Interchange Center, the center line
of which strip of land is described as follows:
Beginning at a point on the North line of said Lot 9,
distant 55.0 feet East from the Northwest corner of said
Lot 9, as measured along said North line; thence South
parallel to the West line of said Lot 9, a distance of
268 feet; thence deflecting to the right 60 degrees from
the last described course, a distance of 63.5 feet, more
or less, to the said West line of Lot 9 and there
terminating.
This instrument is exempt from the State Deed Tax.
It is the intention and agreement of the Parties hereto that
reconstruction
the party of the second part shall in the or maintenance
of said utility and drainage systems replace any shrubs or sod removed
reconstruction
by any excavation in connection with such or maintenance
work, in as newly as possible the same condition as before such excavation.
