THIS INSTRLMENT, Made this —?-9thday of April , 1966, by
and between _ John J. McCauley and T. F. McCauley and June M. McCauley,
the wife of John J. McCauley, and BetV J. MCCauley, the wife of T. F. McCauley
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITT ESSETH, That the said parties of the first part, in consid-
eration of One and Nc 1100 Dollars ($1.00), to`them in`hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity for all utility and drainage purposes
including, but not being limited to, sanitary sewer, storm sewer, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:

That part of Lot 7, Auditor's Subdivision No. 196, Hennepin County.
Minnesota, described as follows:
Beginning at the point of intersection of the north line of Lot 2,
McCauley Heights Second Addition with the Easterly line of Margaret's
Lane; thence Bast along the North line of said Lot 2 a distance of
170 feet; thence at a right angle Borth a distance of 10 feet; thence
Westerly to a point in the Easterly line of Margaret's Lane, distant
20 feet Northerly, measured along said Easterly line, from the point
of beginning; thence Southerly along said Easterly line 20 feet to
the point of beginning.
That part of Lots 6 and 7, Auditor's Subdivision No. 196, Hennepin
County, Minnesota, being a strip of land 15 feet in width and 7k
feet on each side of the following described center line, towit:
Beginning at the point of intersection of the North line of Lot 2,
McCauley Heights Second Addition with the Easterly line of Margaret's
Lane; thence East along the North line of said Lot 2 a distance of
154 feet to the actual point of beginning of the center line to be
described; thence Northeasterly deflecting to the left 45020' a
distance of 102.6 feet; thence Northeasterly deflecting to the
right 9051' a distance of 160 feet; thence Northwesterly deflecting
to the left 84005' a distance of 205 feet; thence Northwesterly
deflecting to the left 3046' a distance of 172 feet; thence North-
easterly deflecting to the right 49013' a distance of 142.4 feet;
thence Northwesterly deflecting to the left 36033' a distance of
130 feet; thence Northeasterly in a straight line to a point in the
Westerly line of Post Lane, distant 25 feet Northerly of the North-
westerly corner of Lot 3, Block 1, Naas Lake Side Addition, and there
terminating.
Also including a 15 foot strip of land, 100 feet in length, the center
line of which being a 100 foot extension Southwesterly of the last
described course of the center line hereinabove described.

It is the intention and agreement of.the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage systems replace any shrubs or sod removed
jby any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
