EASEMENT
THIS INSTRUMENT, Made this 17th day of November 19 67
by and between Eugene W. Schroeder and Lillian C. Schroeder, husband and
wife , of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consider-
ation of One and No /100 Dollars ($1.00), to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity for sanitary sewer and storm sewer, in-
cluding the right to enter for the purpose of constructing, maintaining,
altering, repairing and reconstructing said sanitary sewer and storm
sewer systems in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit:
A ten foot (10') wide strip of land within Lot 4, Block 5, Indian Hills,
the center line of which is described as follows:
Commencing at a point on the South line of Lot 4, Block 5, Indian
Hills, which point is 28.60 feet Northeast of the Southwest corner of said
Lot 4, Block 5; thence Northeasterly to a point on the North line of
said Lot 4, Block 5, which point is 247.20 feet Northeasterly of the
Northwest corner of said Lot 4, Block 5, Indian Hills and there
terminating.
Together with a temporary construction easement ten feet (10') in width
lying on either side of the above described easement. Said temporary
easement shall terminate on December 31, 1968.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said sanitary sewer and storm sewer systems, replace any shrubs,
sod, or driveway removed or damaged by any excavation or movement of
equipment in connection with such construction or maintenance work,
to the satisfaction of the party of the first part.
This instrument is exempt from the State Deed Tax.
