EASEMENT FOR STORM SEWER
THIS INSTRUMENT, Made this 15th day of September , 1966 , by
and between John D Lyon M.D. and Evelyn S. Lyon. husband and wife
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Uina,

a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no/100 (1.00) Dollars,'to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, anal over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
The West and South five feet (51) of the East thirty -six and five
tenths feet (36.5x) of Lots 11 and 12,,Block 12, Mendelssohn
Addition.
Together with a temporary construction easement fifteen feet (151)
in width on the East and North side of the above described
permanent easement, said temporary easement shall terminate on
December 31, 1966.
This instrument is exempt from State Deed Tax

It is the intention and agreement of the Parties hereto that`the party °
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.

Dear Florence:
I have prepared and enclose herewith three copies of an
Application by the Village of Edina to obtain a 10 foot strip of land
over Lot 12, Block 12, Mendelssohn for purposes of storm sewer easements.
This application is to the State of Minnesota since the said lot has been
forfeited for non - payment of taxes. It is necessary, since it has
been forfeited, to file three copies of this application with the County
and if approved by the County, the State will consider the matter and if
approved by the State they will convey to the Village the requested
property.
Will you please, therefore, have all copies of the enclosed
application signed by Mr. Bredesen and yourself in the two spaces noted
for your signatures and have a Notary Public complete the jurat in the
lower right hand corner and return all copies to me.
If you have any questions, please advise.

Dear Florence:
On November 14, 1966, the Village Council adopted a resolution
requesting submission of an application in the State of Minnesota to obtain'
storm sewer easements over a portion of the West 138.5 feet of Lot 12,
Block 12, Mendelssohn Addition. Thereafter, the necessary application
was prepared and submitted to the County and the County then advised us
that this property was sold by the State of Minnesota to one Robert G.
Stire and Lillian M. Stire, husband and wife, as joint tenants. The sale
was for $2,113.61. The buyers reside at 405 Lake Road, Hopkins, Minnesota.
Upon checking with the County as to why these properties were sold, they
advised us of and gave to us a copy of a resolution by the Village Council
passed March 16, 1964, whereby the Council approved the sale of this
property, and other properties, as non - conservation land. It appears,
therefore, that for a period of over two years the Village has had opportunity
to buy this property and not having taken that,opportunity, the State has,
now sold it. I think it therefore incumbent upon the Village, if it desires
to obtain the storm sewer easement over the property, to obtain an easement
from the buyers.
A copy of the resolution given to us by the County is attached
together with a copy of the non - conservation list to which the resolution
relates.
