EASEMENT
THIS INSTRUMENT, Made this 13�day of - j y_ _I , 1961, by
and between Thomas F McCauley & Betty J. McCauley, husband & wife;
John J. McCauley & June M. McCauley, husband and wife
, of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consid-
eration of One and No /100 Dollars ($1.00), to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity for all utility and drainage purposes
including, but not being limited to, sanitary sewer, storm sewer, water
pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit;
That part of Lots 6 and 7, Auditor's Subdivision No. 196,
Hennepin County, Minnesota, being a strip of land 20 feet
in width and 10 feet on each side of the following described
center line, towitx
Beginning at a point in the Easterly line of Margaret's Lane,
distant 40 feet Northerly, measured along said Easterly line,
from the North line of Lot 2, Mc Cauley Heights Second
Addition; thence North 54045'20" East, 64.81 feet; thence
North 37038120" East, 104.7 feet; thence North 7024150" East,
78.04 feet; thence North 8020' West, 95.47 feet; thence North
52023' Nest, 285.8 feet; thence North 22051' East, 112.8 feet;
thence North 37043' East, 127.7 feet; thence North 57010' East
to a point in the Westerly line of Post Lane, distant 35.53
feet Northerly of the Northwest corner of Lot 3, Block 1, Naas
Lakeside Addition, and there terminating.
For purposes of this description the Northerly line of said
Lot 2, McCauley Heights Second Addition, is assumed to bear
South 87019' West.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage systems replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
This instrument is exempt from State Deed Tax.
