It is the intention and agreement of the Parties hereto that the party

before such excavation.

(Issued pursuant to Minnesota Statutes, Section 282.01, Subdivision 1)
THIS INDENTURE, made this 3rd _ day of March 19kl, between the
State of Minnesota, as party of the first part, and Village of Edina, a Municipal
Corporation , as party of the second part, WITNESSETH:
WHEREAS, the land hereinafter described was duly forfeited to the State of Minnesota for the non-
payment of taxes, and,
WHEREAS, pursuant to Minnesota Statutes Section 282.01, Subdivision 1, the party of the second
part has applied to the Commissioner of Taxation for-the conveyance of lands hereinafter described to be
used by it exclusively for construction of storm sewer pips, drainage and ponding
, and,
WHEREAS, the Board of County Commissioners of the County of HENNEPIN ,
State of Minnesota, has recommended to the Commissioner of Taxation by resolution adopted on the
27 st day of February 19L7 , that such conveyance be made,
NOW, THEREFORE, The State of Minnesota, pursuant to said laws and in consideration of the prem-
ises, does hereby grant, bargain, sell and convey unto the party of the second part, forever, all the tracts
or parcels of land lying and being in the County of HENNEPIN , State of Minnesota,
described as follows, to -wit:
East Fifty, (50) feet of South Ten (10) feet
of North Three Hundred Ten (310) feet of:32� ,,,`, DULY
Block Twenty —two (22), Mendelssohn, accordings v ��
to the recorded plat thereof, Hennepin
County, Minnesota,
TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and appurtenances there-
unto belonging or in anywise appertaining, to the said party of the second part so long as it shall con-
tinue to use said land for the purposes aforesaid, and upon condition that if such use shall cease said
land shall revert to the party of the first part as provided by law. No deed tax will be payable on this
conveyance.

and between Emmett M. Carroll and Esther F. Carroll, husband
and wife , of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no/100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
A ten foot (10') strip of land the center line of which is
described as follows:
Commencing at a point in the West line of Lot 1, Rearrangement
of Block 23, Mendelssohn, said point being a distance of eighty -
three feet (83') North of the Southwest corner of said Lot 1;
thence Northeasterly to a point in said Lot 1, a distance of
one hundred eighty -three feet (1831) North of the South line of
Lot 1 and one hundred sixty -nine feet (1691) East of the West
line of said Lot 1 and there terminating.
Together with a temporary construction easement fifteen feet (151)
on either side of the above described permanent easement, said
temporary easement shall terminate on December 31, 1967.
The granting of this easement by the parties whose signatures
appear below, is not to be construed as an endorsement in part
or total of the storm sewer project as a whole in this area.
This instrument is exempt from the State Deed Tax.
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.
