THIS INSTRUMENT, Made this 20thdav of November , 1968, by
and between Carl A. and Virginia G. Hustad
husband and wife , of the County of Hennepin
And State of Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consid-
eration of One and No /100 Dollars ($1.00), to then in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity �i #frgli�¢}�i�i

pipes, including the right to enter for the purpose of constructing,
maintaining, altering, repairing and reconstructing said utility-- -
$r` in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
A ten foot (101) wide strip of land, the center line of which
is described as follows:
Beginning at a point on the West line of Lot 5, Block 4,
Edina Highlands, which point is thirty -four feet (341) South
of the Northwest corner of said Lot 5; thence Northeasterly
at an angle of 650 51 ", turned clockwise from said Northwest
corner of Lot 5, to the East line of said Lot 5.
Also a temporary construction easement ten feet (101) in width
lying on each side of and abutting the above described per-
manent easement. Said temporary easement shall terminate on
December 31, 1968.
It is the intention and agreement of the Parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage systems replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
This instrument is exempt from the State Deed Tax
