EASEMENT FOR STORM SEWER
THIS INSTRUMENT, Made this 12th day of June , 19 6$, by
and between Joseph Buchan and Ruth E. Buchan, husband and wife
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no/100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wits
That 'Dart of Lot 1.6, Auditor's Subdivision No. 196 lying
within a ten foot (10') wide strip of land, the center line
of which is described as follows:
Beginning at the center of Indian Hills Circle; thence
Northeasterly on a radial line which is the Southwesterly
extension of the Westerly line of Lot 1, Blocs: 1, Indian
Hills, a distance of thirty -four feet (34'); thence Northerly,
at a deflection angle of 260 11' to the left, a distance of
sixty -three and seventy -one hundredths feet(63.71'); thence
Northeasterly, at a deflection angle to the right of 41 01
a distance of one hundred :Feet (100') and there terminating.
This instrument is exempt from the State Deed Tax
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.
