the grantor, her heirs, and assigns.
It is the indention and agreement of the Parties hereto that the party of the second
part shall in the construction, at maintenance of said utility and drainage systems
replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition
as before such excavation. Also, the bituminous driveway existing on the above
property will be replaced after construction with a surface equal to or better than
the original.

Dear Bob:
The other day I discussed with someone in your department the
interest of the City in the above two lots. Apparently this person had
some communication on the subject with Ward Lewis, attorney for the prop-
erty owner. A review of the courthouse records indicates that the certi-
ficate of title for the above two lots (Certificate No. 463270) is in the
name of one, Juliet A. Overholt. There are two deeds memorialized on the
certificate of title in favor of the Village of Edina, Document Nos.
916516 and 971154. Both contain language that reads as follows:
The premises above described are hereby conveyed solely for
street and public utility purposes and subject to conditions
that if the grantee should use the land for other purpose or
purposes or should it cease to be used for streeL or utility
purposes the title shall then go back to the grantor.
It is my understanding that you have the copies of both of these deeds in
your files. Ward Lewis, however, has the Owner's Duplicate Certificate of
Title. The Village did not become full owner of these properties and en-
titled to a certificate of title because the deeds were restricted to "street
and public utility purposes." Therefore, the Examiner of Titles construed
the deeds as mere grants of an easement and not evidence of a fee title and
therefore only memorialized them on Mrs. Overholt's certificate.
I discussed this with Ward Lewis. The City's interests are pro-
tected, but Mrs, Overholt may desire to retain fee ownership. Lewis, however,
was going to speak with her about conveying full fee title to the City since
