Upon receiving and filing the Report of the Examiner of Titles in
the above entitled matter,
IT IS ORDERED, That you, and all persons interested, appear before
this Court on the 30th day of October , 19 73, at 2 :00 P.M. in
Room 10 -A of the Hennepin County Court�l!ouse in said County, and then,
or as soon thereafter as said matter can be heard, show cause, if any
there be, why this Court should not enter an Order as follows:
That the Registrar of Titles, upon the filing with him of a certified
copy of this Order,show by memorial upon Certificate of Title Nos.
387742, 453772 and 475334 that the easements and agreements shoran in
deed Doc. No. 803257, files of the Registrar of Titles, have been
terminated and that upon the issuance of future Certificates of Title
for said lands, he omit the recitals relative to said easements and
agreements and that he also omit the memorial of this Order.
IT IS FURTHER ORDERED, That this Order be served at least 7 days
prior to such hearing upon the above named parties residing in this
State in the manner provided by law for the service of Summons in a
civil action; it shall be served at least 10 days prior to such hear-
ing upon any of the above named non - residents by sending a copy of
this Order by mail to such non - resident at his post office address, by
registered or certified mail, return receipt; it shall be served upon
any party who cannot be found by two weeks published notice and by
sending a copy of this Order at least 10 days prior to the hearing by
wail to such party at his last known address and by sending another
copy of this Order to his address as stated in the Certificate of
Title if an address is so stated,

We have examined the title to the above described premises as
shown by a certain Registered Property Abstract certified to September 4,
1969, at 7 A.M., by Title Insurance Company of Minnesota. Based upon such
examination we are of the opinion that as of September 4, 1969, at 7 A.M.,
the fee title to said premises was vested in VERGEL B. EDWARDS and EDITH
M. EDWARDS, husband and wife, free and clear of all liens, charges and
encumbrances, except as.follows:
1. The Village is purchasing only a portion of the above described
property, said portion being described as follows:
That part of Tract B, Registered Land Survey No. 1126, Files
of the Registrar of Titles, Hennepin County, Minnesota, lying
Southerly and Westerly of the following described line:
Beginning at the most Southerly corner of said Tract B;
thence Northwesterly at an angle of 12° 001, as turned Northerly
from the South line of said Tract B, a distance of six hundred
and sixty -five feet (665') to a point of curve to the right
with a radius of two hundred and ninety -five feet (295') and
a delta angle of 77° 30'; thence Northwesterly and Northerly
along said curve a distance of three hundred ninety -nine and
three hundredths feet (399.03') to a point of reverse curve
to the left, said curve to the left having a radius of one
hundred and forty -five feet (145'); thence Northerly along
said curve to the left to the South line of County Road No.
158 (Vernon Avenue) and there terminating.
The deed and other documents involving the acquisition by you should,
therefore, use the description contained in this paragraph 1.

2. We have been advised by the Registrar of Titles that he
will not request a registered land survey in connection with the use
of the description contained in paragraph 1 hereof as a means of dividing
said Tract B into two separate parcels.
3. There is memorialized upon the Certificate of Title, of
said Tract B. a Contract for Deed from Frank J. Ciskovsky and Dorothy
Ciskovsky to Vergel B. Edwards and Edith M. Edwards, husband and wife.
This Contract is memorialized as Document No. 505329, is dated July 27,
1956 and was filed August 2, 1956. I am advised by the Registrar of
Titles that this memorial will be dropped from any new certificate
issued pursuant to a deed from Vergel B. Edwards and Edith M. Edwards,
husband and wife. I set this out for completeness only and not to make an
objection to title.
4. Tract B is subjectto, and also is together with, an
easement for public utility purposes over and across a strip of land 20
feet wide, the centerline of which is the Southerly line of Tract A,
Registered Land Survey No. 1126. Said Tract B is also together with an
easement for roadway purposes over the Easterly 60 feet of said Tract A.
Said easements were created by Document No. 803257, files of the Registrar
of Titles, Hennepin County, Minnesota. Said document contains other
provisions relating to the construction of sewer and water service and
roadway along said easements. However, the property to be acquired
by the Village, as described in paragraph 1 hereof, lies Southerly
of the easement areasabove described. They are, therefore, mentioned
for completeness only and not to make an objection to title.
5. Taxes due and payable in 1968 and prior years are paid.
Taxes due and payable in 1969 in the amount of $2,880.98 are one -half
paid and one -half not paid.
6. The abstract examined contains no certificate as to special
assessments against the property. Pursuant to the option agreement
between the Village and the above named owner, all special assessments
levied and assessed against the property described in paragraph 1 hereof
are to be paid in full by the above named owner. We require that such
a certificate be obtained evidencing the amount of special assessments
remaining unpaid against the property described at paragraph 1 above.
This opinion is limited to the matters shown by said Registered
Property Abstract and records referred to therein. All matters not so
shown are excepted from this opinion and include (a) rights of any

parties in possession, (b) possibility of liens for improvements in
process or completed on the premises within the last ninety (90) days,
(c) general zoning and building laws and restrictions, (d) special
assessments, (e) matters which an accurate survey of the premises would
disclose, and (f) security interests in crops or fixtures under Chapter
336, Minnesota Statutes, not appearing in the Registered Property Abstract.
