I enclose herewith two original, recorded copies of Conveyances
of Forfeited Lands from the State of Minnesota running in favor of
the Village of Edina, both covering a portion of Garden Avenue vacated.
Both are dated May 2, 1969 and one has been recorded as Document No.
3775563 and the other as Document No. 3775468, both in the office of
the Register of Deeds, Hennepin County, Minnesota. I send these to you
to be retained in your records.
You will recall that the exact place of recording these
Conveyances was somewhat in dispute. The property may or may not be
registered property. Because of the inability to determine exactly
whether it is registered property we recorded the Conveyances in the
office of the Register of Deeds. We thereafter attempted to record
them in the Torrens office but were advised that in order to do that
we would have to bring a proceeding subsequent so as to have a certif-
icate of title issued for the properties. Thereafter, pursuant to our
discussions, it was decided that it was not worth the additional funds
required to bring that proceeding subsequent to show of record in the
Torrens office the tax deeds to the Village of Edina. Therefore, there
is no filing of these deeds in the Torrens office.

THIS INDENTURE, made this 2nd day of May 1969 , between the
State of Minnesota, as party of the first part, and __ Villa ge of Edina ,
A Governmental Subdivision , as party of the second part, WITNESSETH:
WHEREAS, the land hereinafter described was duly forfeited to the State of Minnesota for the non-
payment of taxes, and,
WHEREAS, pursuant to Minnesota Statutes Section 282.01, Subdivision 1, the party of the second
part has applied to the Commissioner of Taxation for the conveyance of lands hereinafter described to be
used by it exclusively for park pirpose5
and,
WHEREAS, the Board of County Commissioners of the County of Hennenli n ,
State of Minnesota, has recommended to the Commissioner of Taxation by resolution adopted on the
22nd day of April 1969, that such conveyance be made,
NOW, THEREFORE, The State of Minnesota, pursuant to said laws and in consideration of the prem-
ises, does hereby grant, bargain, sell and convey unto the party of the second part, forever, all the tracts
or parcels of land lying and being in the County of Hennepin State of Minnesota,
described as follows, to -wit:
That part of the West 30 feet of Garden Avenue vacated lying
between the "forth line of the South 264 feet of Lot 5 extended
and the South line of Lot 2 extended, Garden Park, Hennepin Co.,
Minn. according to the recorded map or plat thereof
TO HAVE AND TO HOLD THE SAME, together with all the hereditaments and appurtenances there-
unto belonging or in anywise appertaining, to the said party of the second par(so long as it shall con-
tinue to use said land for the purposes aforesaid, and upon condition that if such use shall cease said
land shall revert to?the party of thejirst part as provided by law. ) No deed tax will be payable on this
conveyance.
IN TESTIMONY WHEREOF, the State of Minnesota, party of the first part, has caused this deed to
be executed in its name in the City of St. Paul, Ramsey County, Minnesota, the day and year first above
written.
