DECLARATION
WHEREAS, SHELL OIL COMPANY, a Delaware corporation,
hereinafter called the "Declarant ", is the owner of certain property
situate in the Village of Edina, County of Hennepin, State of Minnesota,
legally described as follows:
The West 24. 62 feet of Lot 1 and the East 20 feet of Lot 2,
Block 1, Stevens 1st Addition to Minneapolis, according

io the recorded plat thereof, subject to restriction, reserva-
tions and easements of record, if any,
and
WHEREAS, Declarant is willing to restrict the use of said
property as hereinafter provided.
NOW, THEREFORE, in consideration of the Village of Edina
rezoning the above described property and in further consideration of
other good and valuable consideration, the receipt and sufficiency of which
is hereby acknowledged by said Declarant, said Declarant does hereby
impose the following covenants and restrictions:
1. The West 10 feet of the East 20 feet of Lot 2, Block- 1,
Stevens 1st Addition to Minneapolis, according to the recorded plat thereof,
Hennepin County, Minnesota subject to the above mentioned matters shall
be used only as a buffer zone containing landscaping, including a flagstone
terrace, sod, trees and shrubs,
2. The said buffer zone shall be maintained in a good state of
repair.
3. The covenants and restrictions herein contained shall run with
said land and shall also bind the successors and assigns of said Declarant
for a period of thirty (30) years from the date hereof; provided, however,
the covenants and restrictions herein contained shall terrninate absolutely
at such time as Lot 1 of said Block 1, Stevens.lst Addition to Minneapolis,
is no longer used for a service station, automobile car wash establishment
or similar or related purpose.
4. The covenants and restrictions herein contained shall be for

the benefit of the Village of Edina, and the Village of Edina shall have
the right to enforce the same in law or in equity including but not limited
to the right to enjoin any violation thereof.
