Re: That part of Lot 56, Auditor's Subdivision No. 172, Hennepin
County, Minnesota described as beginning at Northeast corner
of said Lot 56; thence South along East line of said lot, a
distance of 76.62 feet; thence Northwesterly 68.29 feet along
a curved line, concave to the Southwest, having a radius of
43.5 feet and being tangent to East line of said lot; thence
West in a straight line, tangent to last described curve, a
distance of 26.43 feet; thence Northwesterly 77.66 feet on a
tangential curve to the right, having a radius of 130 feet
to an intersection with the West line of the East 143 feet
of said Lot 56; thence North along West line 11.14 feet to
North line of said lot; thence East along said North line
143 feet to beginning.
Gentlemen:
We have examined the title to the above described premises as shown
by an Abstract of Title last certified to July 8, 1969 at 7:00 o'clock A.M.
by Title Insurance Company of Minnesota. Based upon such examination, we are
of the opinion that as of July 8, 1969 at 7:00 o'clock A.M., fee title to said
premises was vested in DAVID E. THOMAS JR., a /k /a DAVID E. THOMAS, and
VIRGINIA S. THOMAS, husband and wife as joint tenants, free and clear of all
liens, charges and encumbrances, except as follows:
1. An Agreement dated June 10, 1950, filed July 3, 1950 and recorded
in Book 1854, page 558; and an Agreement dated June 10, 1950, filed September
5, 1951 and recorded in Book 1900, page 60. Said agreements by and between
Earl C. Gilbert and Bonnie D. Gilbert, husband and wife, provide for the
disposal of sewage from the dwelling located on the tract of land which the
captioned premises are a part. The sewer pipe has been laid along the South

10 feet of the North 72 feet of the East 300 feet of Lot 56, Auditor's
Subdivision No. 172, and connects with the main sewer line of the Village
of Edina in Gorgas Avenue. The Agreement provides that any and all repairs,
replacements or reconstruction of said sewer pipe from a pipe approximately
6 -1/2 feet East of the East curb line of said Gorgas Avenue to the main sewer
line in Gorgas Avenue that may at any time become necessary, including the
excavation thereby and the restoration of the premises affected thereby, shall
be done jointly, by the parties hereto or their heirs or assigns and the expenses
thereof born equally by them. The Agreements also contain a provision that all
earth, sod and shrubbery removed in the event excavation is required in making
repairs or r placements of the sewer pipeline serving the dwelling currently
owned by David E. Thomas, Jr. and Virginia S. Thomas, shall be restored by
David E. Thomsa, Jr, and Virginia S. Thomas, or their heirs or assigns. Since
the dwelling located on the property of which the captioned premises is a part
is being removed, we require that Earl C. Gilbert and Bonnie D. Gilbert, David
E. Thomas, Jr. and Virginia S. Thomas, and the Village of Edina, or their heirs,
executors, successors or assigns agree to terminate said agreements.
2. A Mortgage dated April 14, 1967, filed April 17, 1967 and recorded
in Book 3651 of Mortgages, page 572. Said mortgage was executed by David E.
Thomas, Jr. and Virginia S. Thomas in favor of First Federal Savings and Loan
Association of Minneapolis, a United States of America corporation, was given
to secure a note in the original principal amount of $9,000.00. Said mortgage
constitutes that portion of the captioned premises lying within the North 72
feet of the East 143 feet of Lot 56, Auditor's Subdivision No. 172.
3. Mortgage dated June 23., 1965, filed June 25, 1965, and recorded in
Book 3541 of Mortgages, page 408. Said mortgage was executed by David E. Thomas
and Virginia S. Thomas in favor of First Federal Savings and Loan Association
of Minneapolis, a United States of America corporation, was given to secure a
note in the original principal amount of $8,000.00. Said mortgage constitutes
a lien only on that portion of the captioned premises located within the South
60 feet of the East 1/2 of Lot 56, Auditor's Subdivision No. 172, except the
West 155 feet thereof.
4. Real estate taxes payable in 1968 and prior years are paid. Real
estate taxes payable in 1969 in the amounts of $507.38 and $436.90 are one -
half paid and one -half unpaid.
This opinion is limited to the matters shown by said Abstract of Title
and the records referred to therein. All matters not so shown are excepted
from this opinion and include (a) rights of any parties in possession, (b)
possibility of liens for improvements in process or completed on the premises

within the last ninety (90) days, (c) general zoning and building laws and
restrictions, (d) special assessments, (e) matters which an accurate survey

and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, do Grant to
said party of the second part a Temporary Easement for slope or embankment
purposes, including the right to enter for the purpose of constructing such
slope or embankment in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit:
North seventy -two feet (72') of the East one hundred forty -three
feet (143') of Lot 56, Auditor's Subdivision #172, Hennepin
County, Minnesota.
This instrument is exempt from the State Deed Tax
Said Temporary Easement for slope or embankment purposes shall
cease and terminate on 31st day of December , 1970
