County, Minnesota, described as beginning at a point in North
line of said Lot 56, distant 157,195 feet West of Northeast
corner thereof; thence East along North line of said lot, a
distance of 14-195 feet; thence South parallel with East line
of said Lot, a distance of 18.33 feet; thence Northwesterly
23.23 feet to point of beginning, according to the map or plat
thereof on file and of record in the office of the Register of
Deeds in and for Hennepin County, Minnesota
Gentlemen:
We have examined the title to the above described premises as shown by
an Abstract of Title last certified to June 13, 1969 at 7 :00 o'clock A.M. by
Title Insurance Company of Minnesota. Based upon such examination, we are of
the opinion that as of June 13, 1969 at 7 :00 o'clock A.M., fee title to said
premises was vested in MILES B. HIRSCHEY and AUDREY G. HIRSCHEY, husband and
wife as joint tenants, free and clear of all liens, charges and encumbrances,
except as follows:
1. The present fee owners of the captioned premises took title by an
Executor's Deed dated July 9, 1954, filed July 12, 195+ and recorded in Book
2003 of Deeds, page 431 executed by Earl C. Gilbert, Jr., as Executor of the
Estate of Bonnie D. Gilbert, deceased. The certificate of the Clerk of Probate
Court under Court Seal, Hennepin County, Minnesota, states that the Letters
Testamentary appointing Earl C. Gilbert, Jr. as Executor of the Estate of
Bonnie D. Gilbert, deceased, are in full force and effect only as of June 15,
1954. We require that a certificate by the Clerk of Probate Court, under
Court Seal, Hennepin County, Minnesota, be placed of record certifying that

the Letters Testamentary appointing Earl C. Gilbert, Jr., Executor of the Estate
of Bonnie D. Gilbert, deceased,are in full force and effect as of July 10, 1954.
2. A mortgage dated July 9, 195+, filed July 12, 195+ and recorded in Book
2784 of Mortgages, page 191. Said mortgage was executed by the present fee owners
in favor of First Edina State Bank to secure a note in the original principal amount
of $11,500.00. The title of First Edina State Bank has subsequently been changed
to First Edina National Bank. We require that the captioned premises be released
of record from said mortgage.
3. The real estate taxes payable in 1968 and prior years -are paid. The
real estate taxes payable in 1969 in the amount of $773.20 plus penalty are unpaid.
This opinion is limited to the matters shown by said Abstract of Title and
the records referred to therein. All matters not so shown are excepted from this
opinion and include (a) rights of any parties in possession, (b) possibility of
liens for improvements in process or completed on the premises within the last
ninety (90) days, (c) general zoning and building laws and restrictions, (d)
special assessments, (e) matters which an accurate survey of the premises would
disclose, and (f) security interests in crops or fixtures under Chapter 336,
Minnesota Statutes, not appearing in the Abstract of Title.
