NOTICE OF ADVERSE CLAIM
(Section 508.70 Minnesota Statutes)
An easement for storm sewer dated September 11, 1970 was
granted to the Village of Edina, a municipal corporation organized
under the laws of the State of Minnesota�by Frieda A. Leininger, widow,
in, under and over the following described property situate in the
County* of Hennepin and State of Minnesota, to -wit:
The East twenty -five feet (251) of Lot 13, Block 1,
Minikanda Vista 3rd Addition, Morningside.
A copy of said easement is attached hereto as Exhibit A and
made a part hereof.
The registered owner of the above described property is the
State of Minnesota, subject to any Auditor's Certificate of Purchase as
appears in the records of the Hennepin County Auditor. Lot 13, Block 1,
Minikanda Vista 3rd Addition, Morningside, Minnesota, was purchased by
said Frieda A. Leininger May 27, 1970, and Hennepin County Auditor's
Certificate of Purchase of Tax Forfeited Lands No. 74646 covering said
Lot 13 was executed June 8, 1970, pursuant to said sale, said purchaser being
in possession under said Certificate of Purchase.
The easement given to the Village of Edina grants to it an
interest in the property therein described adverse to said registered
owner, the State of Minnesota (Certificate of Title No. 162806).
The address of Village of Edina is 4801 West 50th Street,
Edina, Minnesota, 55424, and any notice or notices to be served upon it
under this Notice of Adverse Claim may be served upon it at such address.

EASEMENT FOR STORM SEWER
THIS INSTRUMENT, Made this 11-th day of September , 19 70, by
and between Frieda A. L,eininger, widow
of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That tho said parties of the first part, in consieera-
tion of One and no/100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey, and Warrant to said party of the second part an Ease-
ment in perpetuity for storm sewer purposes, including the right to enter
for the purpose of constructing, maintaining, altering, repairing and recon-
structing a storm sewer system in, under, and over the following described
property situate in the County of Hennepin and State of Minnesota, to -wit:
Easement for storm sewer over the East
twenty -five feet (25') of Lot 13, Book 1,
Minikanda Vista 3rd addition, Morningside.
This instrument is exempt from the State Deed Tax
It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said storm sewer
replace any shrubs or sod removed by any excavation in connection with such con-
struction or maintenance work, in as nearly as possible the same condition as
before such excavation.

Dear Mrs. Hallberg:
Enclosed is a carbon copy of the above easement executed by
Frieda A. Leininger. This property is being purchased by Mrs. Leininger
on a contract from the State of Minnesota, which is the present registered
owner of the property. To enable us to register this easement and have
it appear as a memorial on the certificate of title held by the State of
Minnesota, it will be necessary to file a Notice of Adverse Claim. Enclosed
are three copies of a notice which we have prepared in this regard. Would
you please execute two copies of the notice, including the verification on
the second page, and return them to me, retaining one copy�f the notice
and the carbon copy of the easement for your files. ��
