Z A q t3 a R r^ t b; ~ . p -A O, V C1 rd E 4 < TSE:mj 5/26/71 38895'78 AGREEMENT w t THIS AGREEMENT, made and entered into this -7 day of d riY/,na- I 1971, by and between RAUENHORST CORPORATION, a Minnesota corporation (hereinafter called 10Rauenhorst ") and VILLAGE OF EDINA, a Minnesota cipal corporation, (hereinafter called "Edina "), WITNESSETH, THAT: WHEREAS, Rauenhorst has conveyed to Edina certain property the Village of Edina described as follows: a in All that part of Outlot A, Nine Mile North, according to t e Plat thereof on file or of record in the Office of the Register of Deeds in and for Hennepin County, Minnesota, lying Westerly of a line drawn 220 feet Easterly of and parallel with the West line of Lincoln Drive as shown on and dedicated by said plat of Ni e Mile North, and the extensions North and South of said par llel line to the North and South lines of said Outlot A, and al o including all of the property within said Lincoln Drive as shown on said plat, (hereinafter called "Subject Land "); and WHEREAS, the balance of the land in said plat of Nine MilelNorth is owned by Rauenhorst and the Subject Land is a strip of land including and lying adjacent to Lincoln Drive as shown on said plat of Nine Mile orth, and Rauenhorst and Edina desire to make the following agreements relati e to special assessments and development costs in connection with said prat of Nine Mile North. NOW, THEREFORE, for and in consideration of One Dollar ($�.00) and other good and valuable consideration to each of the parties he�eto in hand paid by the other, the receipt and sufficiency of which is acknowledged by each, the parties hereby agree as follows: 1970 AND PRIOR TAXES PAID Dept. of Finance,)". That all of the special assessments now levied or pend ng against the Subject Land shall be re- allocated or allocated, as the ase may be, to the balance of the property in said plat of Nine Mile Nor h, excluding the Subject Land, so that the Subject Land shall be free a d clear of all special assessments now outstanding or pending, and Rauenhors hereby agrees to such re- allocation and allocation of such special assessments. Any such re- allocation of existing special assessments shall be made as soon as possible after recording of the conveyance of the Subject Land to Edina and any such allocation of pending special assessments shall be mad in connec- tion with the normal special assessment procedures of Edina. 2. It is understood and agreed that Lincoln Drive as sho n on said plat of Nine Mile North is not yet constructed or developed. n con- nection with the construction and development of the portion of Lin�oln Drive shown on said plat in the future any special assessments to b levied in connection therewith shall not be levied against the Subject Lan but, if levied on a front foot basis, shall be levied wholly against Lot 1 and 2, Block 1 of said plat of Nine Mfl e North, one -half to each of sai lots, and if levied on other than a front foot basis, shall be levied on he prop- erty in said plat of Nine Mile North excluding the Subject Land; it being agreed that the Subject Land has no need of and will not benefit fr m the construction or development of said Lincoln Drive. 3. This agreement shall be binding on and inure to the benefit of the parties hereto and their respective heirs, successors and a signs, and shall be deemed a covenant running with the land in said plat f Nine Mile North, including the Subject Land. -2- C This instrument is exempt from State Deed Tax.
