Re: Lots 1, 2,.and 3, except that part,of said lots taken
by the State of Minnesota for state highway purposes,
and except that part of said Lots 2 and 3 lying South -
westerly of a line running from a point on the West li
.of said Lot 2, distant 15.86 feet South from the North
west corner of said Lot 2 to a point on the South line
of said Lot 3, distant 39.22. feet West from the Southe
corner of said Lot 3, all in Block 3, Grand View Heigh
according to the plat thereof on file or of record in
the office .of the Register of Deeds in and for Hennepi
County, Minnesota.
We have examined the title -to the above described premises
shown by a Registered Property Abstract, Certificate.of Title No. 264
certified to December 3, 1970 at 7:00 A.M. by Title Insurance Company
Minnesota. Based upon such examination, we are of the opinion that a
December 3, 1970 at 7:00 A.M., fee title to said premises was vested
GRANDVIEW CONSTRUCTION COMPANY, a Minnesota corporation, free and cle
of all liens, charges and encumbrances, except as follows:
1. A Mortgage dated March 31, 1970, filed April 23., 1970 1
the ,office of the Registrar of Titles in and for Hennepin County, Mir
as Document No. 967581, executed by the .aforesaid fee owner in favor
Minnesota Federal Savings and Loan Association, a United States of Ar
Corporation, and given to secure a note in the original principal am(
of $250,000.00. We require that a Partial Release of Mortgage be obi
from Minnesota.Federal Savings and Loan Association releasing the cal
premises from the lien of said Mortgage and filed for record in the c
of the Registrar of Titles in and for Hennepin County, Minnesota.

It should be noted that a Mortgagee's Duplicate Certific to
of Title has been issued for the.aforesaid Mortgage.
2. An undated Notice of Lis Pendens was filed on December 8,
1970 in the office of the Registrar of Titles in and for Hennepin Count
Minnesota and recorded as Document No. '984704 in the matter of the Co
of Hennepin vs. Bardevco, Inc. . . . Grandview Construction Co., et
(Condemnation No. 1026), the object and purpose of which is to.acquir
the temporary right to construct slopes on and remove materials from
that part ,of the captioned premises described as follows:
That part of Lot 1, Block 3, except that part of said
lot taken by the State of Minnesota for state highway
purposes, lying Northwesterly of a line drawn parallel
with and distant 5 feet Southeasterly .of the Southerly
line of County State Aid Highway No. 158 and between
two radial lines drawn Southeasterly from points
thereon distant 66 feet and 104 feet Northeasterly
of the West line of said Lot 1 as measured along -
said Southerly line.
Said temporary right expires December 31, 1972.

The aforesaid Notice of Lis Pendens also recites that e
purposes of said action is to acquire the right, where necessary, to
enter and shut off at the source all power, electrical or gas, to all
lights or other equipment lying within the above described tract acq red
d erein.
3. The,office of the Registrar.of Titles advises that the
Owner's Duplicate. Certificate is at the Torrens Office.
4. The real estate taxes payable in 1969 and prior years re
paid in full. The real estate taxes payable in 1970 in the amount o
$12,359.28 are one -half paid and one -half unpaid plus penalty. (ass ssed
in the name of Grandview Construction Company as Plat 75560, Parcel 461,
Edina 24)

shown are excepted from this opinion and include (a) rights of any p rties

premises other than the above named fee owner, or if anyone else is i
possession, that they do not claim any title or interest in the premi es.
With respect to ,(b) above, we further suggest that you satisfy yourse f
by a visual inspection of the premises that there have been.no,improv merits
in process or completed on the premises within the last ninety (90) d ys,
or if there have been such improvements, inquiry should be made to de er-
mine that said improvements have been paid for in full.
