EASEMENT
THIS INSTRUMENT, Made this 6th day of October , 1972, by

husband and wife of the County of Hennepin .

and State of ] Minnesota, parties of the first part, and the Village of
Edina, a municipal corporation organized under the laws of the State of
Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in consid-
eration of One and No /100 Dollars ($1.00), to them in hand paid by the
said party of the second part, the receipt whereof is hereby acknowledged,
do Grant, Bargain, Sell, Convey and Warrant to said party of the second
part an Easement in perpetuity for all utility and drainage purposes
including, but not being limited to, sanitary sewer, storm sewer, water
pipes, including the right to enter for the purpose of..constructing,
maintaining, altering, repairing and reconstructing said utility and
drainage systems in and over the following described property situate
in the County of Hennepin and State of Minnesota, to -wit:
The South 7.5 feet of the West 311.75 feet of Lot 7, Auditor's
Subdivision No. 325.
Also that part of said Lot 7 lying Northerly of the above de-
scribed easement and Southwesterly of a line running from a
point on the West line of said Lot 7, distant 45 feet North of
the Southwest corner of said Lot 7, to a point 40 feet East of
the West line and 7.5 feet North of"the South line of said Lot 7.
The East 160 feet of the North 7.5 feet of said Lot 7.
A strip of land, 15 feet in width, the centerline of which is
described as follows:
Beginning at the Northeast corner of said Lot 7, thence South-
westerly, a distance of 100-feet, to a point 20 feet West of
the East lane of said Lot 7; thence Southerly, 20 feet West
of and parallel with the East line of said Lot 7 to a point
7.5 feet North of the South line of said Lot 7.
Also temporary construction easements, 10 feet in width, lying
on all sides of and abutting the above described permanent
easements within said Lot 7. Said temporary easements shall
terminate on June 30, 1973.
This instrument is exenlp t from the Stake De_" Tax.
It is the intention And agreement of tiie parties hereto that
the party of the second part shall in the construction, or maintenance
of said utility and drainage system replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such excavation.
