HomeMy WebLinkAbout1660VA t- 3963354 EASEMENT THIS INSTRUZIENT, Made this/Z day of ✓ �Z 19 7 -by and between �' / /�� l� A�0, hr r,4Rel Z_) /// wife and husband , of the County of Hennepin and State of Minnesota, parties of the first past, and the Village of Edina, a municipal corporation organized under the 14tws of the State of Minnesota, party of the second part; WITNESSETH, That the said parties of the first part, in consid- eration of One and No /100 Dollars ($1.00), to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to said party of the second part an Easement in perpetuity for all utility and drainage purposes including, but not being limited to, sanitary sewer, storm sewer, water pipes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing said utility and drainage systems in and over the following described property situate in the County of Hennepin and State of Minnesota, to -wit: That part of Lot 1, Bloch 1, Margaret Cosgrove's Addition described as follows: Beginning at a point on the South line of said Lot 1, which point is one hundred twenty -five and three tenths feet (125.3') East of the Southwest corner of said Lot l; thence East along the South line of said Lot 1 a distance of fifteen feet (15'); thence Northerly, at right angles to said South line, a distance of seven and five tenths feet (7.5'); thence Westerly, parallel with the South line of said Lot 1, a distance of fifteen feet (151); thence Southerly to the point of beginning. Also a temporary construction easement ten feet (10') in width, parallel with and abutting the above described permanent easement on the North, East and West sides. Said temporary easement shall terminate on July 1, 1973. This instrument is exempt from the State Deed Tax It is the intention and agreement of the Parties hereto that the party of the second part shall in the construction, or maintenance of said utility and drainage systems replace any shrubs or sod removed by any excavation in connection with such construction or maintenance work, in as nearly as possible the same condition as before such excavation.
