THIS INSTRUMENT, Made this 2nd day of October , lg 74,
by and between A. C. Eggert and Olive D. Eggert
husband and wife , of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and Imo /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged do G.rant,Barcain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for sanitary
sewer purposes, including the right to enter for the purpose of con-
structing, maintaining, altering, repairing and reconstructing a
sanitary sewer system in and over the following described property
situate in the County of Hennepin and State of Minnesota, to -wit:
That part of the following described property:
Lot 2, Block 40 Arden Park 3rd Addition. Also commencing at the
Southwest corner of said Lot 2s thence South along the extension of the
West line thereof to the Borth line of Lot 27, Brookside Terraces thence
East along said North line a distance of 40 feett thence South at right
angles to said North line to Kinnehaha Creeks thence Easterly along said
Creek to the intersection with the Southerly extension of the Bast line
of said Lot 21 thence North along the said extension to the Southeast
corner of said Lot 21 thence West to beginning (includes vacated street
and accretions) lying within the following described easement:
The South 27.5 feet of the Bast 15 feet of the iciest 30 feet of that part
of vacated Motor Street lying South of said Lot 2, Block 4 and lying
between the Southerly extension of the Fast and West lines of said 3,ot.2.
Also a 14 foot wide temporary construction easement lying Easterly,
Northerly and Westerly of and abutting the above described permanent
easement. Said temporary easement shall terminate on July 1, 1975.

It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said sanitary sewer replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation.
This instrument is exempt from State Deed Tax.
IN WITNESS WHEREOF, The said parties of the first part
have hereunto set their hands and seals the day and year first
above written.
