THIS INSTRUMENT, Made this 1st day of October , 19_1k,
by and between
David L. \,Fleming and Susan D. F
husband and wife of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the second part, the receipt whereof is
hereby acknowledged, do Grant,Bargain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for sanitary
sewer purposes, including the right to enter for the purpose of con-
structing, maintaining, altering, .repairing and reconstructing a
sanitary sewer system in and over the following described property
situate in the County of Hennepin and State of Minnesota, to -wits
That part of Lots 27 and 28, Brookside Terrace lying Fast of the west
111 test thereof and last of a line running parallel to and 40 feet
rast from the West lint of Lot 2, Black 4, Arden Park 3rd Addition
extended South to Minnehaha crook (also includes secretions and adjacent
j of vacated Short Street) lying within a 15 foot widee easeswent, the
centerline of which is described as follows
comencing at a paint on the centerline of vacated Motor Street which
point is 23.72 feet East of the intersection of the Southerly extension
of the Nest line of Lot 2, Block 4, Arden Park 3rd Addition with said
conteriino of Motor Street; thence Southwesterly, at a deflection angle
to the left of 66 027131" as turned from the centerline of Motor Street,
a distance of X$3.5 feats thence Southwesterly at a deflection angle to
the right of 360361360# a distance of 164.31 feet s thence Southeasterly
at a deflection angle to the left of 48014.05" to the centerline of
vacated Short Street.
Also a temporary construction easement lying 10 feet on all sides of and
abutting the above described permanent easement and westerly and Bortherly
from the abcwe described permanent easement to a line 5 feet from and
parallel to the Rasterly and northerly sides of the residence located on
said property. Said temporary easement shall terminate on July 1, 1975.
It is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said sanitary sewer replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation.

This instrument is exempt from State Deed Tax.

have hereunto set their hands and seals the day and year first
