THIS INSTRUMENT, Made this 14th day of December , 1973 ; by
and between Ethel.M. Berg,
widow , of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota.,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey and Warrant to said party of the second part an Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to wit:
That part of Lot Twenty -nine (29), except the West One hundred and eleven (111)
feet thereof, in Brookside Terrace, and all that portion of the South Half
(S 1/2) of Short Street vacated lying East of the East line of the West One
Hundred Eleven (111) feet of said Lot 29, and all that portion of the North
one -half of Short Street vacated lying between extensions across it of the
East and West lines of the Easterly 80 feet of the Westerly 191 feet of Lot
28, Brookside Terrace, all according to the plat thereof on file and of record
in the office of the Registrar of Titles in and for.said Hennepin County, lying
within a 15 foot easement, the centerline of which is described as follows:
Commencing at a point on the centerline of vacated Motor Street which
point is 23.72 feet East of the intersection of the Southerly exten-
sion of the tidest line of Lot 2, Block 4, Arden Park 3rd Addition with
said centerline of Motor Street; thence Southwesterly, at a deflection
angle to the left of 86 °27'31" as turned from the centerline of Motor
Street, a distance of 53.5 feet; thence southwesterly at a deflection
angle to the right of 36°36'36", a' distance of 164.31 feet; thence
Southeasterly, at a deflection angle to the left of 48 °14'05 ", a dis-
tance of 90.1 feet; thence Southeasterly, at a deflection angle to the
left of 2502311511, a distance of 71.1 feet; thence Southeasterly at a
deflection angle to the left of 24021'30", a distance of 71.1 feet;
thence Southwesterly at a deflection angle to the right of 72 020'4511,
a distance of 22.04 feet; thence Southeasterly, at a deflection angle
to the left of 26 °15', a distance of 292:10 feet and there terminating.
Also a temporary construction easement lying 10 feet on all sides of
and abutting the above described permanent easement. Said temporary
easement shall terminate on July 1, 1974.-
This instrument is exempt from the State Deed Tax

It is the intention and agreement of the Parties hereto that the party
of the second part shall in the constructions or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
IN WITNESS WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year first above written.
