EASEMENT FOR SANITA ZY SEWER
THIS INSTRUMENT, Made this lst day of.

by and between Loyd C. Wertz and Trane K, Wertz
husband and wife , of the County of Hennepin
and State of Minnesota, parties of the first part, and the City of
Edina, a municipal corporation organized under the laws of the State
of Minnesota, party of the second part;
WITNESSETH, That the said parties of the first part, in
consideration of One and No /100 Dollars ($1.00), to them in hand
paid by the said party of the secoad part, the receipt whereof is
hereby acknowledged, do G.rant,Baraain, Sell, Convey and Warrant to
said party of the second part an Easement in perpetuity for sanitary
sewer purposes, including the right to enter for the purpose of con-
structing, maintaining, altering, repairing and reconstructing a
sanitary sewer system in and over the following described property
situate in the County of Hennepin and State of Minnesota, to -wit:
That part of the North 34 feet of that part of Lot 33, Brookside
Terrace lying East of the West 111 feet thereof and the South 43
feet of that part of Lot 33, Brookside Terrace and the North 17
feet of that part of Lot 34, Brookside Terrace lying East of the
West 111 feet of said Lots 33 and 34, lying within a 15 foot ease-
ment, the centerline of which is described as followss
Commencing at a point on the centerline of vacated Motor Street which
point is 23.72 feet East of the intersection of the Southerly extension
of the West line of Lot 2, Block 4, Arden Park 3rd Addition with
said centerline of Motor Street; thence Southwesterly, at a deflection
angle to the left of 86027'31" as turned from the centerline of Motor
Street, a distance of 53.5 feet; thence Southwesterly at a deflection
angle to the right of 360361361), a distance of 164.31 feet; thence
Southeasterly, at a deflection angle to the left of 48014'05% a
distance of 90.1 feet; thence Southeasterly, at a deflection angle
to the left of 25023115 ", a distance of 71.1 feet; thence Southeasterly
at a deflection angle to the left of 24021130 ", a distance of 71.1
feet; thence Southwesterly at a deflection angle to the right of
72020145% a distance of 22.04 feet; thence Southeasterly, at a
deflection angle to the left of 260151, a distance of 292.10 feet
and there terminating.
Also a temporary construction easement lying 10 feet on all sides of
and abutting the above described permanent easement. Said temporary
easement shall terminate on July 1, 1975.
it is the intention and agreement of the Parties hereto
that the party of the second part shall in the construction, or
maintenance of said sanitary sewer replace any shrubs or sod removed
by any excavation in connection with such construction or maintenance
work, in as nearly as possible the same condition as before such
excavation.
This instrument is exempt from State Deed Tax.
IN WITNESS WHEREOF, The said parties of the first part
have hereunto set their hands and seals the day and year first
above written.
