HomeMy WebLinkAbout1722EASEMENT FOR SANITARY SEWER THIS INSTRUMENT, Made this 10th day of December 19 73, by and between Alice K. Brill, M. D. , Single , of the County of Hennepin and State of Minnesota, parties of the first part, and the Village of Edina, a municipal corporation organized under the laws of the State of Minnesota, i party of the second part; WITNESSETH, That the said parties of the first part, in considera- tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged, do Grant, Bargain, Sell, Convey and Warrant to said party of the second part an Easement in perpetuity for sanitary sewer purposes, including the right to enter for the purpose of constructing, maintaining, altering, repairing and reconstructing a sanitary sewer system in and over the following described property situate in the County of Hennepin and State of Minnesota, to wit: That part of the South 60 feet of that part of Lot 34, Brookside Terrace lying Bast of the West 111 feet thereof, lying within a 15 foot easement, the centerline of which is described as follows Commencing at a point on the centerline of vacated Motor Street which point is 23.72 feet Bast of the intersection of the Southerly exten- sion of the west line of Lot 2, Block 4, Arden Park 3rd Addition with said centerline of Motog Streets thence Southwesterly, at a deflection angle to the left of 86 27131" as turned from the centerlins of Motor Street, a distance of 53.5 feet] thence Southwesterly at a deflection angle to the right of 36036'36", a distance of 164.31.feeti thence Southeasterly, at a deflection angle to the left of 48 01400500, a dis- tance of 98.1 feet' thence Southeasterly, at a deflection angle to the left of 25 2311500 a distance of 71,1 feet: thence Southeasterly at a deflection angle to the left of 24 21130 ", a distance of 71.1 festt thence Southwesterly at a deflection angle to the right of 72020'45", a distance of 22.04 feet: thence southeasterly, at a deflection angle to the left of 26 15', a distance of 292.10 feet and there terminating. Also a temporary construction easement lying 10 feet on all sides of and abutting the above described permanent easement. Said temporary easement shall terminate on ably 1, 1974. This instrument is exempt from the State Deed Tax.
