EASEMENT FOR SANITARY SEWER
THIS INSTRUMENT, Made this 20th clay of December 1973 _..� by
and between Charles D. Marta and Joanne A. Merta
husband and wife , of the County of Hennepin
and State of Minnesota, parties of the first part, and the Village of Edina,
a municipal corporation organized under the laws of the State of Minnesota,
party of the second part;
WITNESSETH, That the said parties of the first part, in considera-
tion of One and no /100 (1.00) Dollars, to them in hand paid by the said party
of the second part, the receipt whereof is hereby acknowledged, do Grant,
Bargain, Sell, Convey and Warrant to said party of the second part an Easement
in perpetuity for sanitary sewer purposes, including the right to enter for the
purpose of constructing, maintaining, altering, repairing and reconstructing
a sanitary sewer system in and over the following described property situate in
the County of Hennepin and State of Minnesota, to -wit:
That part of Lot 35, Brookside Terrace lying East of the West 111
feet thereof, also Lot 43, Auditor's Subdivision 176, lying within
a 15 foot easement, the centerline of which is described as follows
Commencing at a point on the centerline of vacated Motor Street which
point is 23.72 feet East of the intersection of the Southerly exten-
sion of the test line of Lot 2, Block 4, Arden Park 3rd Addition with
said centerline of Motor Street? thence Southwesterly at a deflection
angle to the left of 86027'31" as turned from the centerline of Motor
Street, a distance of 53.5 feet= thence Southwesterly at a deflection
angle to the right of 360361360, a distance of 164.31.geete thence
Southeasterly, at a deflection angle to the left of 48 14105 ", a dis-
tance of 90.1 feet, thence Southeasterly, at a deflection angle to the
left of 25023'15", a distance of 71.1 'feett thence Southeasterly at a
deflection angle to the left of 24021'30", a distance of 71.10feet?
thence Southwesterly at a deflection angle to the right of 72 201450,
a distance of 22.84 feet= thence Southeasterly, at a deflection angle
to the left of 26 151, a distance of 292.10 feet and there terminating.
Also a temporary construction easement lying 10 feet on all sides of
and abutting the above described permanent easement. Said temporary
easement shall terminate on July 1, 1974.
This instrument is ,exempt from the State Deed Tax

It is the intention and agreement of the Parties hereto that the party
of the second part shall in the construction, or maintenance of said sanitary
sewer replace any shrubs or sod removed by any excavation in connection with such
construction or maintenance work, in as nearly as possible the same condition as
before such excavation.
IN WITNESS: WHEREOF, The said parties of the first part have hereunto
set their hands and seals the day and year first above written.
